Ordinance 1065 - Approving Certain Projects as Urban Renewal ProjectW ORDINANCE NO. 1065 AN ORDINANCE RELATING TO THE KALISPELL DOWNTOWN REDEVELOPMENT PLAN; APPROVING CERTAIN PROJECTS AS URBAN RENEWAL PROJECTS. WHEREAS, the City Council of the City of Kalispell on the loth day of September, 1979,,pursuant to Title 7, Chapter 15, Parts 42 and 43, Montana Code Annotated, enacted Ordinance No. 933 entitled ORDINANCE APPROVING THE KALISPELL DOWNTOWN REDEVELOPMENT PLAN FOR THE CITY OF KALISPELL, MONTANA AS AN URBAN REDEVELOPMENT PLAN AND THE FEASIBILITY OF RELOCATION; AUTHORIZING THE MAYOR TO IMPLEMENT THE PLAN WITH POWERS CONTAINED IN THE URBAN RENEWAL LAW, and WHEREAS, said Ordinance contained a provision for tax increment financing for Projects with an area designated as the Kalispell Downtown Redevelopment Area, and WHEREAS, certain urban renewal "Projects" have been submitted to the City for review and said Projects have been reviewed by the Kalispell City -County Planning Board for compliance with Kalispell City -County Master Plan, and WHEREAS, the Kalispell City -County Planning Board after reviewing the proposed Projects have advised the City Council, in writing, that the projects, as a part of the Kalispell Downtown Redevelopment Plan, conforms with the Kalispell City -County Master Plan, and WHEREAS, on the 16th day of September, 1985 the City Council of the City of Kalispell passed Resolution No. 3619, entitled A RESOLUTION OF INTENTION TO MODIFY THE DOWNTOWN REDEVELOPMENT PLAN TO APPROVE CERTAIN URBAN RENEWAL PROJECTS, and WHEREAS, on the 21st day of October, 1985, pursuant to Resolution No. 3619, the City Council of the City of Kalispell, after due and proper notice under Section 7-15-4215 MCA, held a Public Hearing on said Projects and received expressions from the public, supporting and opposing said Projects, and WHEREAS, the City Council of the City of Kalispell finds with respect to each Urban Renewal Project proposed in Resolution No. 3619 as follows: a. a workable and feasible plan exists for making available adequate housing for persons who may be displaced by the Projects; b. the Plan, as modified to include the Projects, conforms to the comprehensive plan or parts thereof of the city; C. the Plan, as modified to include the Projects, will afford maximum opportunity, consistent with the needs of the City as a whole, for the rehabilitation or redevelopment of the Area by private enterprise; d. a sound and adequate financial program exists for the financing of the Projects; e. the Projects constitute urban renewal projects within the meaning of the Act and the Plan. WHEREAS, after considering the evidence submitted at said public hearing, the City Council of the City of Kalispell considers it in the best interest of the City to designate and approve certain Urban Renewal Projects in the Kalispell Downtown Redevelopment Area. WHEREAS, the City proposes to issue and sell bonds of the City payable from the tax increment collected within the project area in an aggregate amount of two million one hundred thousand dollars ($2,100,000) to finance the Urban Development Projects . NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION 1. That the City Council of the City of Kalispell hereby modifies the Kalispell Downtown Redevelopment Plan for the City of b I- Kalispell and designates the following Projects as Urban Renewal Projects under Title 7, Chapter 15, Parts 42 and 43 MCA and the Kalispell Downtown Redevelopment Ordinance: a. Parking Improvements Project. This Project will consist of the acquisition of land for and the construction of parking spaces in the Project Area. The estimated cost of the Parking Improvements Project is approximately $500,000. The City shall finance the cost of the Parking Improvement Project through the sale of TIF Revenue Bonds. b. West Side Park Project. This Project will consist of the acquisition of land for and the furnishing and equipping of a neighborhood park adjoining the Elrod Grade School with the Project Area. The estimated cost of the West Side Park Project is $200,000. The City shall finance the cost of the West Side Park Project through the sale of TIF Revenue Bonds. c. Redevelopment Project. This Project will consist of the acquisition by the City of certain parcels of land deemed "blighted" as defined by the Act within the Project Area and the undertaking of clearance and demolition activities necessary to make the land available for redevelopment by private enterprise. The estimated cost of the Land Redevelopment Project is $500,000. The City shall finance the cost of the Redevelopment Project through the sale of TIF Revenue Bonds. d. 5th Avenue West Construction Project. This Project consists of reconstruction of 5th Avenue West from Center Street to 6th Street West in the Project Area. The estimated cost of the 5th Avenue West Construction Project is $800,000. The City shall finance the cost of the 5th Avenue West Construction Project through the sale of TIF Revenue Bonds. e. Depot Park Loop Elimination. This project consists of the elimination of an undedicated Street on the Easterly and Northerly boundary of a City Park commonly known as Depot Park as shown on Map, Exhibit "Ell, Page 13 of the Kalispell Downtown Redevelopment Plan. The City upon eliminating the road shall use the property to expand Depot Park and to provide Twenty -Fight (28) parking spaces for use by individuals visiting the park and using the old Great Northern Depot. This project is being financed by money budgeted from the Tax Increment Fund and is a portion of the Center Street Reconstruction Project. SECTION II. The Urban Renewal Projects herein designated and approved may be modified by the City Council of the City of Kalispell if the Council determines by Resolution that an adjustment to a Project or Projects is required in the best interest of the City of Kalispell. SECTION III. All actions of the City Council heretofore taken with respect to the Projects herein designated, to the extent not inconsistent herewith, are ratified and confirmed. SECTION IV. This Ordinance shall take effect from and after 30 days of its passage by the City Council and approval by the Mayor.
