Ordinance 1043A - Parking - Third Avenue Eastdv, -�;71 ORDINANCE NO. _04 I( AN ORDINANCE TO AMEND SECTION 17-54, THE KALiSPELL CITY CODE TO PROHIBIT VEHICLE PARKING WITHIN THIRTY (30)- FEET OF THE INTERSECTION ON THE EAST SIDE OF THIRD AVENUE EAST AT THE INTERSECTION OF THIRD AVENUE EAST AND THIRD STREET EAST; TO DECLARE AN EMERGENCY, TO PROVIDE FOR THE INSTALLATION IN THE EFFECTED AREA AND TO REQUIRE THE MAYOR TO PROCLAIM ORDINANCE IN FORCE WHEN DONE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, SECTION 1. Section 17-54(t) of the Kalispell City Code is hereby amended so that it reads as follows: (t) On Third Avenue East: 1) On the West Side between First Street East and Third Street East, at anytime 2) On the East Side, within thirty (30) f6et of the Intersection, at the Intersection of Third Avenue East and Third Street East SECTION 11. All other portions of Section 17 +54, Kalispell City Code, shall remain unchanged. SECTION 111. The Chief of Police shall immediately cause to be installed approp'iate and adequate signs to indicate the prohibition against parking within thirty (30) feet of the Intersection on the East Side of Third Avenue East. SECTION 1V. An emergency is hereby declared to exist and a second reading of this ordinance is waived. The facts of the emergency are that the intersection of Third Avenue East and Third Street East is a heavy traffic area on the edge of the Downtown Parking Area. Numerous accidents and near accidents have occurred at the intersection because of automobile parking and blocking the view for cars traveling through the Intersection. It is, therefore, necessary to promote the peace, health and safety of the motoring public and tha- City of Kalispell that parking be prohibited on the East Side of Third Avenue East for a distance of thirty (30) feet on either side of the Intersection with Third Street East. SECTION V. This ordinance will be effective immediately upon public proclamation by the Mayor after proper signing and installation of appro- priate and adequate signs by the Chief of Police. This ordinance shall be effective for no longer than 90'days following its passage and approval.
