NOTICE.IS HEREBY GIVEN, Pursuant to Section 7-5-108, M.C.A. and 7-5-4202, M.C.A., that the City Council of the City of Kalispell, Montana, did on the 21st day of March, 1983, conduct a First Reading of Ordinance No. 1027 and Ordinance No. 1028 which were Ordinances adopting the "Uniform Building Code", "Uniform Mech- anical Code" and the "Uniform Code for Abatement of Dangerous Buildings"; and the "Uniform Plumbing Code", respectively; as said codes were amended, adopted and approved by the Building Codes Division, Department of Administration, State of Montana, in accordance with Section 2.32.203, Administrative Rules of Montana. Notice is further hereby given that the City Coun- cil of the City of Kalispell, Montana, intends to finally adopt, at Second Reading, the above referenced codes on the 18th day of April, 1983, at the regular meeting of the City Council at 7:30 P.M., in the Council Chambers, City Hall, Kalispell, Montana. Three copies of the above referenced codes to be adopted together with the appendices adopted and the amendments approved by the Building Codes Division, shall be filed with the City Clerk of the City of Kal- ispell for public inspection, use and examination during regular business hours. PUBLISH: Marj ie Giermann City Clerk -Treasurer l 1 4 8 5 ORDINANCE NO. 1028 AN ORDINANCE, TO ADOPT, BY REFERENCE, THE "UNIFORM PLUMBING CODE", 1982 EDITION, AS THE PLUMBING CODE OF THE CITY OF KALISPELL, AND APPLICABLE TO THE JURISDICTIONAL AREA THEREOF; AS ADOPTED AND AP- PROVED BY THE BUILDING CODES DIVISION, DEPARTMENT OF ADMINISTRATION, STATE OF MONTANA; TO PROVIDE A PENALTY FOR THE VIOLATION OF ANY LAWFUL ORDER ISSUED PURSUANT THERETO; AND REPEALING SECTION 21-1 (ORDINANCE NO. 946), KALISPELL CITY CODE. Pursuant to the authority of the City of provisions of Sections 7-5-108 and 7-S-4202, by the City Council of the City of Kalispell, Kalispell under the M.C.A., be it ordained Montana, as follows: SECTION I. There is hereby adopted, by reference, the "Uniform Plumbing Code", 1982 Edition, Library of Congress Catalog Card Number 78-073977, by the International Association of Plumbing and Mechanical Officials; said code is adopted in its entirety; except for, and with the following amendments: A) Asbestos -cement vent pipe is not an acceptable material in the City of Kalispell for DWV, and B) Homogenous bituminized fiberdrain and sewer pipe is not acceptable material in the City of Kalispell, except in drain .fields, and C). Amend Section 20.5, Page 3a, Work not Requiring a Permit, so that it then reads: "No permit is required for any minor replacement or repair work, the performance of which does not have a significant Rotential for creating a con- dition hazardous to public health and safety. The rovisions of this act do notapply to regularly employed maintenance personnel doing maintenance work on the business premises of their employer unless work is subject to the permit provisions of this act. Factory -.built buildings covered by an insignia issued by the Building Standards Bureau need not have a plumbing 2ermit for the construction of the unit; however, a permit will still be re uired for on site work, as provided for in these rules.", and D) Amend Section 20.7, Page 4a, Schedule of Fees, by deleting lines 11 and 12 and substituting therefore: "For each gas piping system of one (1) to four (4) outlets ... $2.00," and "For each gas piping system of five (5) or more, per outlet ... $ .50,1- E) Amend Section 203(a), Page 14, Use of Copper Tubing, so that it then reads: (a) Copper tube for underground drainage and vent piping shall have a weight of not less than that of copper drainage Type L. F) Section 203(d), Page 14, Use of Copper Tubing, so that it then reads: (d) Copper tube for water piping shall have a weight of not less than Type L. Exception: Type M copper tubing may be used for water piping when piping is above ground in, or on, a building. t'336 G) Amend Section 401(a), Page 3/, Materials, item 2 by amending Section to read as follows: (a) (1) (2) ABS and PVC DWV piping installations shall be limited to residential, commercial, institutional and industrial construction not more than two stories in height, provided that ABS and PVC DWV ma be used for hori- zontal branch lines re ardless of the number of stories.", and H) Amend Section 406(a), Page 40, Cleanouts so that it then reads: (a) "Each horizontal drainage pipe shall be provided with a cleanout at its upper terminal and each run of piping, which is more than one hundred (100) feet (30.4m) in total developed length, shall be provided with a cleanout for each fifty (50) feet (15.2m) or fraction there- of, in length of such piping. Lines six (6) inches in size and larger shall be provided with a cleanout for each one hundred (100) feet (30.4m) or fraction thereof, in length of such piping.", and i) Section 407, Page 41, Grade of Horizontal Drainage Piping so that it then reads "Horizontal drainage piping shall be run in a practical alignment and a uniform slope of not less than one-fourth (4) of an inch per foot (20.9mm/m) or two (2) per cent toward the point of disposal provided that, where it is impractical due to the depth of the street and sewer or to the structural features or to the arrangement of any buildings or structures to obtain a slope of one- fourth (4) of an inch per foot (20.9mm/m) or two (2) per cent, any such pipe or piping two (2) inches (50.8mm) or larger in diameter may have a slope of not less than one -- eighth (1/8) of an inch per foot (10.4mm/m) or one (1) per cent, and d) Amend Section 409(a), page 41, Drainage of Fixtures Located Below the Next Upstream and Manhole or Below_ the Main Sewer Level to read: a) Drainage, piping, serving fixtures which have flood level rims located below the elevation of the next upstream manhole cover of the public sewer serving such drainage, piping may be protected from back flow of sewage by installing an approved type back water valve. Fixtures above such elevation shall not discharge through the back water valve, and K) Amend Section 503(a), Page 45, Materials to read: (a) (1) (2). ABS and PVC DWV piping installations shall be limited to residential, commercial, institu- tional and industrial construction not more than two stories in height, provided that ABS .and PVC DWV may be used for horizontal branch lines re- gardless of the number of stories, and L) Amend Section 506(a) (c), Page 46 to 47, to read as follows: a) Each vent pipe ofl:stack shall be extended through its flashing and shall terminate vertically not less than twelve. (12) inches (304.8mm/m) above the roof nor less than one (1) foot (.3m) from any vertical surface, and 1 1 337 c) Vent pipe shall be extended separately or combined, a full required size, not less than twelve (12) inches (304.8mm/m) above the roof or firewall. Flagpoling events is prohibited except where the roof is used for purposes other than weather protection. All events within ten (10) feet (3m) of any part of the roof that is used for such other purposes shall extend not less than seven (7) feet (2.1m) above such roof and shall be securely stayed, and M) Amend Section 1004(a), Page 75, Materials to read as follows: a) Water pipe and fittings shall be of brass, copper, cast iron, galvanized malleable iron, galvanized wrought iron; galvanized steel, lead or other approved materials. Asbestos -cement, PB, PE or PVC water pipe manufactured to recognized standards may be used for cold water distribution systems outside a building, provided however, that this same material may extend to a point immediately inside the building when a sleeve for all pipe ass.ing through or under concrete construction and valve are provided at a point of entrance. PB water pipe and tubing may be used for hot and cold water distribution systems within a building. All .materials used in the water supply system, except valves and similar devices shall be of a like material, except where otherwise approved by the Administrative Authority, and N) Amend Section 1008(3), Page 77, Installation and_ Inspec- tion in Testing to read as follows: (3) (f) Disinfection. When required by the Administrative Authority having jurisdiction, potable water systems or any part thereof in- stalled or repaired shall be disinfected in accordance with one of the following methods: i) By filling the system or any part thereof with a solution containing fifty parts per million of available chlorine and allowing it to stand for a minimum period of six hours before flushing, or ii) By filling the system or any part thereof with a solution containing one hundred parts per million of available chlorine and allowing it to stand for a minimum period of two hours before flush- ing, or iii) In the case of a potable water storage tank where it is not possible to disinfect by one of the above methods, the entire in- terior of the tank shall be swabbed with a solution containing two hundred parts per million of available chlorine and allowing it to stand two hours before flushing, or iv) In the case of potable water filters or similar equipment.; the mixture shall be determined by the Administrative Authority having jurisdiction. O) Amend Section 1009(h), Page 79, Size of Potable Water Piping to read as follows: h) Knowing the available pressure at the water meter or other source of supply, and after subtracting one-half (�) pounds per square inch pressure for each foot (11.3kPa per. m) of.difference in elevation between such source of supply and highest water supply outlet in the building or on the premises, use the "pressure range" group within which this pressure will fall. Select the "length" column which is equal to or longer than the required length. Follow down the column to a fixture unit valve equal to or greater than the total number of fixture units required by the instal- lation. Having located the proper fixture unit for the required length, size of meter.and build- ing supply pipe will be found in the two left hand columns. No building supply pipe shall be less than three-quarter 13/4) inch (19.1mm) in inside diameter. P) Amend Section 1106(a), Page 86 to 87, Grade, Support and Protection of Building Sewers to read as follows: (a) Building sewers shall be run in practical alignment and at a uniform slope of not less than 4 (one -quarter) of an inch per foot (20.9 _. mm per m) toward the point of disposal; provided that where it is impractical, due to the depth of the street sewer or to the structural features or to the arrangement of any building or structure, to obtain a slope of 4 (one -quarter) of an inch per foot (20.9 mm per m), any such pipe or piping three (3) inches (76.2 mm) or larger may have a slope of -not less than 1/8 (one -eighth) of an inch per foot (10.5 mm per m), when approved by the Administrative Authority. SECTION II. Compliance with Uniform plumbing Code; License; Bond. All plumbing work done within the City shall conform to the rules, regulations and requirements described and defined in the Uniform Plumbing Code, and shall be inspected and ap- proved in the manner therein set forth; A) All work of plumbing and drainage shall be. performed by a Journeyman plumber, duly licensed hereunder as such, and under the supervision of an employing or Master Plumber duly licensed and bonded as such as herein provided; provided, that such licensure and supervision.shall not be re- quired in those instances setforth in Section 37-69-102, M.C.A. A change in plumbing and drainage system shall be governed by the same rules applying to any work. B) A person engaged in the business of plumbing in the City, either as a Master or as a Journeyman Plumber, rescribed by Section shall first secure a license, as p 37-69-301, M.C.A.; and in addition thereto must first obtain a license from the City Clerk -Treasurer at the following rates: i) Master Plumber's License, twenty-five dollars ($25.00) per year or any fraction thereof. ii) Journeyman Plumber's License, five dollars ($5.00) per year or any fraction thereof. All such licenses so issued by the City Clerk -Treasurer shall expire December 31 of each year, and shall be -e- newed annually at the time prior to expiration, upon payment of $10.00 for each Master Plumber's License and $5.00 for each Journeyman Plumber's License. Any ifsuch renewal shall be for a period of one (1) year. the license granted and issued to a Master or Journeyman Plumber by the Board of'Plumbers shall be suspended or revoked by the Board of Plumbers, such action shall also constitute a similar suspension or revocation of the license granted to such person by the City of Kalispell. Also, the City Council of the City of Kalispell may, upon good cause shown and after affording such licensee a fair hearing., revoke or suspend any City license granted and issued here- under. Willfull violation ofany of the eeprovisions gof the a shall be plumbing code of the city by Y l cause for such a suspension or revocation. C) No person shall engage in the business of plumbing under a Master Plumber's License without first obtaining and furnishing to the City a public liability bond in the sum of one thousand dollars ($1,000.00), approved as to form and sufficiency by the City Council and con- dition that such person will, in good faith, perform all the things required of him by they nifordamage Code and that if any injury to any p any property results by reason of his failure or neglect to conform with this chapter, he shall save harmless and indemnify such person injured or the owner of such pro- perty damaged: SECTION III. It is unlawful for any person to knowingly, pur- posely, willfully or negligently violate any lawful order is- sued pursuant to said Uniform Plumbing Code; such a violation is an offense against the City punishable as provided by Section 1-9.0f the Kalispell City Code. 3 4 0 SECTION IV. Section 2-1, Kalispell City Code (Ordinance No. 946) is hereby repealed and all other Ordinances, or parts thereof of the City in conflict herewith are hereby repealed. SECTION V. This Ordinance is effective thirty (30) days following final approval by the Council and the Mayor and the filing with the City Clerk of the prescribed copies of the code hereby adopted by reference.
