Ordinance 1027 - Code Adoption3 3Z, ORDINANCE NO. 1V4 1 AN ORDINANCE, TO ADOPT, BY REFERENCE, THE "UNIFORM BUILDING CODE", 1982 EDITION, THE "UNIFORM MECHANICAL CODE", 1982 EDITION, THE "UNIFORM HOUSING CODE", 1982 EDITION, THE "UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS", 1982 EDITION, AS THE BUILDING CODES OF THE CITY OF KALISPELL, AND APPLICABLE TO THE JURISDIC`I`IONAL AREA THEREOF; AS ADOPTED AND APPROVED BY THE BUILDING CODES DI- VISION, DEPARTMENT OF ADMINISTRATION, STATE OF MONTANA; TO PROVIDE A PENALTY FOR THE VIOLATION OF ANY LAWFUL ORDER ISSUED PURSUANT THERETO; AND REPEALING SECTIONS 5-4.2.AND 5-4.4 (ORDINANCE NO. 939 AND ORDINANCE NO. 928, RESPECTIVELY) KALISPELL CITY CODE. Pursuant to the authority of the City of Kalispell under the provisions of Section 7-5-108 and 7-5-4202, M.C.A., be it ordained by the City Council of the City of Kalispell, Montana, as follows: SECTION I. There is hereby adopted, by reference, the "Uniform' Building Code", 1982 Edition, Library of Congress Catalog Card Number 81--86609, by the International Conference of Building Officials; said code is adopted in its entirety and Appendices Chapters 1, 7 Part I & II, 32, 49, 53, 55; except for: A) The penalty portions thereof, and. B) Section 504, which is amended by adding subsection (d) which reads as follows: (d) Openings for the purpose of interconnecting building of separate ownership in the Downtown Redevelopment Area may occur, however, provided that they shall be protected as required in Section 505 (e)(1) -- Area Separation Walls. The protection may be provided by any labeled fire door assembly of proper rating, provided that; 1. The door shall be self -closing activated by smoke and heat as required by Sec. 4306. 2. No opening shall be made in existing walls before the fire doors are on site and installation of door shall be performed immediately after the opening is made. 3. Integrity of exiting. Each building shall have exits as required by the Uniform Builaing­Code and openings between buildings shall not serve as a required exit. At least three copies of said documents shall be kept on file in the office of the City Clerk for inspection by the public. SECTION II There is hereby adopted, by reference, the "Uniform" Mechanical Code", 1982 Edition, Library of Congress Catalog Card Number 81-86611, by the International Conference of Building Officials, as adopted and approved by the Building Codes Division, Department of Administration, State of Mont- ana; said code is adopted in its entirety; and Appendix B, Chapter 21,, pages 264-280 titled "Steam and Hot -Water Boilers", "Steam and Hot-water Piping (Hydronics)"; except for: A) The penalty portions thereof, and B) Section 2102 shall be amended to read in the first paragraph as follows: "The requirements of this chapter apply to the construction, installation, repair and alteration of steam heating boilers operated at not over 15 pounds per square inch gauge pressure in private residences or apartments of six or less families or to hot water heating or supply I 1 +&JOIlc rs operated aL not over 50 pounds per square inch gauge pressure and temperatures not over 2500 F when in private residences or apartments of six or less families. All other systems are under the control of the Bureau of Safety and Health, Division of Workers' Compensation, Department of Labor and Industry, State of Montana." C) Eliminate Sections 2124, 2125 and 2126 entirely. At least three copies of said documents shall be kept on file in the office of the City Clerk for inspection by the public. SECTION III. There is hereby adopted, by reference, the "Uni- form Housing Code", 1982 Edition, Library of Congress Catalog Card Number 81--86612, by the International Conference of Building Officials in its entirety except for the penalty portions thereof. At least three copies of said documents shall be kept on file in the office of the City Clerk for inspection by the public. SECTION IV. There is hereby adopted, by reference, the "Uniform Code for Abatement of Dangerous Buildings", 1982 Edition, Library of Congress Catalog Card Number 81-86616, by the In- ternational Conference of Building Officials, in its entirety except for the penalty portion thereof. At least three copies of said documents shall be kept on file in the office of the City Clerk for inspection by the public. SECTION V. Said codes shall be the building and mechanical codes of the City regulating the erection, construction, en- largement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use, height, area and main- tenance of all buildings or structures in the jurisdictional area of the City of Kalispell. SECTION VI. It is unlawful for any person to knowingly, pur- posely, wilfully or negligently violate any lawful order issued pursuant to said codes; such a violation is an offense against the City punishable as provided by Section 1-9 of the Kalispell City Code. SECTION VII. Section 5-4.2, Kalispell City Code (Ordinance No. 939), and Section 5-4.4, Kalispell City Code (Ordinance No. 924) is hereby repealed and all other Ordinances, or parts thereof, of the City in conflict herewith are hereby repealed. SECTION VIII. This Ordinance is effective thirty days following final approval by the Council and Mayor and filing with the City Clerk of the prescribed copies of the codes hereby adopted by reference.
