ORDINANCE NO. 1025
AN ORDINANCE TO AMEND ORDINANCE NO. 895 BY PROVIDING A CORRECTED
DESCRIPTION OF CERTAIN REAL PROPERTY ANNEXED TO THE CITY OF KALIS-
PELL AS "SUMMIT RIDGE NO. 1, ADDITION NO. 90"..
W I T N E S S E T H:
WHEREAS, on the 3rd day of July, 1978, the City Council of the
City of Kalispell passed and the Mayor approved Ordinance No. 895
which was "AN ORDINANCE TO PROVIDE FOR THE ALTERATION OF THE BOUNDARY
OF THE CITY OF KALISPELL BY INCLUDING THEREIN, AS AN ANNEXATION,
CERTAIN REALTY TO BE KNOWN AS SUMMIT RIDGE NO. 1, ADDITION NO. 90",
and
WHEREAS, said Ordinance No. 895 contained as Exhibit "A", a
metes and bounds description of the property so annexed as "Summit
Ridge No. 1, Addition No. 90", and
WHEREAS, said Ordinance No. 895 recorded at Book No. 685, Page
No. 18, records of Flathead County, Montana, on the 20th day of
November, 1979, and
WHEREAS, said metes and bounds description was in error and
included therein property not annexed to the City as "Summit Ridge
No. 1, Addition No. 90", and
WHEREAS, it is at this time necessary and desirable that said
description of "Summit Ridge No. 1, Addition No. 90" be corrected.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL AS FOLLOWS:
SECTION I. That Ordinance No. 895 of the City of Kalispell is
hereby amended so that the property description of the real
property annexed to the City of Kalispell as "Summit Ridge No. 1,
Addition No. 90", is as more particularly described in Exhibit
"A-l" attached hereto and for purposes made a part hereof, and
the boundary of the City is hereby altered to so provide.
SECTION II. The balance of Ordinance No. 895 not amended hereby
shall remain in full force and effect.
SECTION III. The City Clerk -Treasurer is hereby directed upon
proper passage and approval of this Ordinance to transmit to
the Flathead County Clerk and Recorder a certified copy of
this Ordinance so that Ordinance No. 895, as recorded at Book
685, Page 18, shall include only those properties annexed to
the City of "Summit Ridge No. 1, Addition No. 90".
SECTION IV. This Ordinance shall be effective thirty (30) days
from and after the date of its final passage by the Council
and approval by the Mayor.
