Good evening City Council,
My name is Anthony Weimer: I reside at 1301 2nd St. W.
Please bear with me as this regards the monolith bearing the ten commandments located on Flathead County public
property. The ten commandments were discussed before this council in 2012 and were objected to as religious.
Now, I am the individual who removed the ten commandments from Flathead County public property on June 27, 2020.
1 was transferred by Kalispell police to the Flathead County sheriff's department on an affidavit of probable cause and
order that was not reviewed by a judge. The Flathead County detention center incarcerated me on a citation with a
bond amount of $0.00. 1 was served a warrant for my arrest on June 29, 2020 while in custody and was not released
until July 6, 2020. To make a long story short, District Court Judge Amy Eddy ruled contrary to municipal code, Montana
code annotated, and both the U.S. and Montana Constitutions. I was sentenced and forced by Judge Eddy to appeal. The
ten commandments were re -erected within 9 days from the sentencing and before the final decision was made in the
case. The case is currently pending in the Flathead County district court after the Supreme Court reversed and
remanded.
Recently in the fall, I started building an addition on my mom's house in Kalispell. The building setback from the road in
the plans was off by approximately six (6) feet. The hole for the foundation was already dug. In order to follow code, a
fully loaded shed had to be moved back and 4 trailer loads of more dirt had to be removed. After completion, the
project is now within code.
Here I have followed the building code per the City. The County must do the same, whether municipal, state or U.S. and
Montana Constitutions.
Forcing religion upon the public on grounds subject to neutrality is discriminating and a violation of civil rights.
I ask that the City of Kalispell confront Flathead County in removing the ten commandments from public property and, if
necessary, set in their face a lawsuit that seeks to mandate such removal.
