Ordinance 1015 - Prohibits Parking on Unnamed Street in Depot Park310 ORDINANCE NO. 1015 AN ORDINANCE TO AMEND SECTION 17-54, THE KALISPELL CITY CODE TO PROHIBIT VEHICLE PARKING ON 'THE UNNAMED STREET IN DEPOT PARK DE- SIGNATED AS "DEPOT PARK LOOP" CONNECTING THE INTERSECTION OF FIRST AVENUE EAST AND CENTER STREET WITH MAIN STREET'; TO DECLARE AN EMERGENCY TO PROVIDE FOR THE INSTALLATION IN THE EFFECTED AREA AND TO REQUIRE THE; MAYOR TO PROCLAIM ORDINANCE IN FORCE WHEN DONE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA: SECTION I. Section 17-54 of'the Kalispell City Code is here- by amended by addition of (r) to read as follows: (r) To prohibit vehicle parking on 'The unnamed street in Depot Park designated as "Depot Park Loop" connecting the intersection of First Avenue East and Center Street with Main Street'. SECTION II.- All other portions of Section 17-54, Kalispell City Code, shall remain unchanged. SECTION III. The Chief of Police shall immediately cause to be installed appropriate and adequate signs to indicate the prohibition against parking on the "Depot Park Loop". SECTION IV. An emergency is hereby declared to exist and a second reading of this ordinance is waived. The facts of the emer- gency are that the reconstruction of Main Street of Kalispell from Center Street to Fifth Street has necessitated a detouring of public traffic over a road ordinarily known as "Depot Park Loop"; the volume of traffic over the road is tremendous and does not lend itself to the parking of vehicles along that.particular stretch known as "Depot Park Loop". It is, therefore, necessary to promote the peace, health and safety of the motoring public and the City of Kalispell that parking along the "Depot Park Loop" be prohibited during the period .of the reconstruction of the Main Street of Kalispell. SECTION V. This ordinance will be effective immediately upon public proclamation by the Mayor after proper signing and installation of appropriate and adequate signs by the Chief of Police. This ordinance shall be effective for no longer than 90 days following its passage and approval. PASSED BY AN AFFIRMATIVE VOTE OF MORE THAN TWO-THIRDS OF THE CITY COUNCIL AND APPROVED BY THE MAYOR THIS DAY OF 1982. E. McDowe. Mayor ATTEST: Marjori Giermann, City Clerk -Treasurer 31_1 P R O C L A M A T 1 0 N WHEREAS, on the bth day of July, 1982, the City Council did pass and 1 did approve Ordinance No. 1015 prohibiting vehicular parking on 'The unnamed street in Depot Park designated as "Depot Park Loop" connecting the intersection of First Avenue East and Center Street with Main Street'; and WHEREAS, said Ordinance No. 1015 was passed as an emergency measure to become effective immediately upon public proclamation by the Mayor after the installation of appropriate and adequate signs by the Chief of Police; and WHEREAS, said installation of appropriate and adequate signs, prohibiting vehicular parking on the "Depot Park Loop", has been accomplished by the Chief of Police. NOW THEREFORE, 1, LeRoy E. McDowell, Mayor, do, pursuant to the power granted me by Ordinance No. 1015, hereby proclaim that said Ordinance No. 1015 is immediately effective and vehicular parking is prohibited on 'The unnamed street in Depot Park desig- nated as."Depot Park Loop" connecting the intersection of First Avenue East and Center Street with Main Street'. This proclamation shall be in full force and effect while said Ordinance No. 1013 is in effect in accordance with Section V, thereof, or until it is repealed, superceded or amended by other action of the Kalispell City Council of the City of Kalispell, Montana.
