AN ORDINANCE TO REPEAL SECTIONS 24-1, 24--2, 24-3, 24-4, 24-5, 24--7, 24-1209
24-73, 24-74, 24--75, 24-76, 24-77, 24-78, 24-79 and 24-80 AND AMEND
SECTION 24-23, KALISPELL CITY CODE; PROVIDE FOR THE ADOPTION OF STANDARDS
AND GENERAL PROVISIONS FOR DESIGN AND CONSTRUCTION; PROVIDE AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA:
SECTION 1. ORDINANCE REPEAL.
The following Sections of the Kalispell City Code and all portions
of ordinances upon which the codification thereof is based, are hereby
repealed:

SECTION 2. ORDINANCE AMENDED.

Section 24-23 of the Kalispell City Code is hereby amended to
read as follows:
If the owner or agent of the owner of any lot or parcel of land
in front of which any sidewalk or curb shall be ordered constructed shall
fail or neglect, during such period of thirty days, to construct such
sidewalk or curb, the City Council may cause the same to be constructed
by the letting of a contract for the construction thereof to the lowest
responsive bidder, after advertising for bids for the construction thereof.
If the construction of such sidewalks or curbs is done by contract, the
advertisement for bids and contract may be for sidewalks or curbs in front
of one or more lots or parcels of land as the Council shall determine.
All sidewalks and curbs in the City shall be constructed.in accordance
with the Standards and General Provisions for Design and Construction,
as adopted by the City Council.
SECTION 3. OTHER SECTIONS.
All other Sections of Chapter 24, Kalispell City Code, not hereby
repealed or amended shall remain in full force and effect.
SECTION 4. ADOPT STANDARDS.
The City Council is hereby authorized to adopt, establish or
change Standards and General Provisions for Design and Construction for
alteration of or improvements added or connected to facilities owned by
the City of Kalispell. The decision of the City Council to adopt,
establish or change such Standards and General Provisions for Design and
Construction shall be made by,resolution duly adopted and approved and
filed with the City Clerk.
SECTION 5. EFFECTIVE DATE.
This Ordinance shall be effective thirty days from its final
passage by the Council and approved by the Mayor.
