Ordinance 995 - Zoning Fee Schedule4 AN ORDINANCE TO AMEND THE CITY OF IiALISPELL ZONING ORDINANCE (.ORDIN-
ANCE NO. 934, AS AMENDED) TO PERMIT CITY COUNCIL TO ESTABLISH FEE
SCHEDULES FOR VARIOUS APPEALS AND APPLICATIONS FOR ZONING CHANGES;
TO PROVIDE FOR EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELLf MONTANA,
AS FOLLOWS:
SECTION I. Section #6.10(b) of the City of Kalispell Zoning
Ordinance (Ordinance No. 934 as amended) is hereby amended to read
as follows:
"(b) The secretary shall maintain and be custodian of
all records of the minutes of the board and find-
ings and decisions of the board. All records
shall be open to the public during regular busi-
ness hours. All appeals from interpretations and
applications for variances shall be in writing on
forms prescribed by the board and shall be accom-
panied by the appropriate fee as may, from time
to time, be established by the City Council to
cover the costs of processing. Every appeal and
application shall refer to the specific provisions
of this ordinance involved and shall set forth
the interpretation that is claimed, the details of
the variance that is applied for and the reasons
for which it is requested that the variance should
be granted, as the case may be. upon an appeal or
application for variance, the zoning administrator
shall prepare and furnish the applicant and the
board a written report of his action, the facts of
the case as he finds them to be and his recommenda-
tion for the board's decision with his reasons
therefore"
. All other portions of said Section #6.10 shall remain un-
changed.
SECTION II. Section #6.13(a)(3) of the City of Kalispell Zon-
ing Ordinance (Ordinance No. 934 as amended) is hereby amended to
read as follows:
"(3) By petition of the owners of fifty percent or more
of the area involved in a petition for a change in
the zoning map;. said petition shall be on forms
prescribed by the commission and accompanied by the
appropriate fee as established, from time to time
by the City Council, to cover the costs of process-

All other portions of said Section #6.13 shall remain un-
changed.
SECTION III. This ordinance shall be effective thirty (30)
days from and after the date finally passed by the Council and ap-
proved by the Mayor.
