ORDINANCE NO. 998
AN ORDINANCE TO REPEAL SECTIONS 26-1, 26-2, 26-3, 26-4, 26-5, 26-6,
26-7, 26-8, 26-10, 26-11, 26-12, 26-13, 26-14, 26-17, 26-18, 26-19,
26-20, 26-21, 26-22, 26-24 and 26-3V, KALISPELL CITY CODE; TO ,PRO-
VIDE FOR ADOPTION OF CITY WATER USER RATES BY METHOD AND.PrOCESS
ALLOWED BY STATE LAWS; TO PROVIDE FOR ADOPTION OF RULES FOR OPER-
ATION OF CITY WATER UTILITY BY METHOD AND PROCESS AS ALLOWED BY
STATE LAWS; TO PROVIDE EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA:
SECTION I. The following Sections of the Kalispell City Code
and all portions of ordinances upon which the codification thereof
is based, are hereby repealed:

SECTION II. The City Council is hereby authorized to adopt,
establish or change the rates, charges or classifications imposed on
the {customers of the City of Kalispell Water Utility in the manner
of and pursuant to the procedures imposed upon and allowed to munici-
pal utility services by the laws of the State of Montana. The deci-
sion of the City Council to adopt, establish or change said rates,
charges or classifications shall be made by resolution duly adopted
and approved and filed with the City Clerk.
SECTION III. The City Council is hereby authorized to adopt,
establish or change rules for the operation of the City of Kalispell
Water Utility. Said rules shall be adopted, established or changed
in the manner of and pursuant to the procedures imposed upon and
allowed to a municipal utility by the laws of the State of Montana.
The decision of the City Council to adopt, establish or change such
rules shall be made by resolution duly adopted and approved and filed
with the City Clerk.
SECTION IV. A schedule of rates, charges or classifications im-
posed upon the customers of the City of Kalispell water Utility and
a copy of the rules established for the operation of said utility
shall be kept and maintained in the office of the head supervisor of
said Water Utility and same shall be made available for public in-
spection at anytime during regular office hours.
SECTION V. All other Sections of Chapter 26, Kalispell City
Code, not hereby repealed shall remain in full force and effect.
SECTION VI. This ordinance shall be effective thirty days from
and after its final passage by the Council and approval by the Mayor.
