ORDINANCE NO. 996
AN ORDINANCE TO AMEND ORDINANCE NO. 714 TO PROVIDE FOR TWO-HOUR
PARKING LIMITATION ON CERTAIN STREETS; TO DECLARE AN EMERGENCY: TO
PROVIDE FOR EFFECTIVE DATE AND TO PROVIDE FOR REPEAL OF ORDINANCE
NO. 992.
WHEREAS, on August 10, 1981, the City Council did pass, and
the Mayor did approve, Ordinance No. 985 amending Ordinance No. 714
(codified as Section 17-90, Kalispell City Code) as an emergency
ordinance, and thereafter on November 1, 1981, said Ordinance No.
985 was replaced by Ordinance No. 992, also as an emergency ordin-
ance; and
WHEREAS, further experience of the City Parking Commission and
the City Council has disclosed that the plan of two-hour parking as
adopted by said ordinance No. 992, should be further amended and
the long-range effects thereof be studied before a permanent ordin-
ance is adopted setting out the area within which a two --hour park-
ing limitation is advisable and necessary and the original emer-
gency continues to exist until same is done.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL, MONTANA:
SECTION I. Ordinance No. 714, codified as Section 17-90, Kalis-
pell City Code, is hereby amended to read:
Sec. 17-90. Overtime parking prohibited; two-hour parking
between '9':00 A.M'.' and' 6:00 P.M.' 'on certain
streets.

A) It shall be unlawful and a violation of the provisions
of this article for any person to cause, allow, permit
or suffer any vehicle registered in the name of or op-
erated by such person to be parked overtime or beyond
the period of legal parking time established for any
parking meter zone as herein described.
B) It shall be unlawful and a violation of the provisions
of this article for any person to permit a vehicle to
remain or be placed in any parking space adjacent to
any parking meter while such meter is displaying a sig-
nal indicating that the vehicle occupying such parking
space has -already been parked beyond the period pre-
scribed for such parking space.
C) It is unlawful and a violation of this article for any
person to permit a vehicle to remain parked continu-
ously in any individual parking space for more than two
hours between 9:00 A.M. and 6:00 P.M. on any day except
Sunday or a legal holiday on the following streets:

SECTION II. The Street Superintendent shall immediately in-
stall appropriate and adequate signs to indicate parking limits on
the streets and avenues effected by this ordinance, and, further,
mark individual parking spaces where parking meters have not here-
tofor been installed therein.
SECTION III. An emergency is hereby declared to exist and a
second reading of this ordinance is waived. The facts of the emer-
gency ate: Expanded on -street parking of vehicles for periods of
more than two hours continuously on the streets and avenues des-
cribed above has resulted from the city's change of policy relating
to public off-street parking lots serving the central business dis-
trict of the city. In turn, such expanded on -street long term .
parking on the above described streets and avenues has resulted in
hardship to residents and businesses abutting said streets in gain-
ing reasonable access to their properties. Further, the City
Council has temporarily suspended enforcement of requiring payment
for on -street parking under the Parking Meter Ordinance, Chapter
17, Article V of the City Code, and time to study the effects of
such a policy will be required before a permanent ordinance there-
fore can be adopted.
SECTION IV. This ordinance shall be effective on the date it
is passed by a proper vote of the City Council and approved by the
Mayor; this ordinance shall remain effective for a period of no
mote than ninety (90) days thereafter; Ordinance No. 992 is hereby
repealed upon the effective date hereof.
