Ordinance 992 - Two Hour Parking - Declaration of EmergencyORDINANCE NO. 992 AN ORDINANCE TO AMEND ORDINANCE NO. 714 TO PROVIDE FOR TWO-HOUR PARK- ING LIMITATION ON CERTAIN STREETS; TO DECLARE AN EMERGENCY; TO PRO- VIDE FOR EFFECTIVE DATE AND TO PROVIDE THAT ORDINANCE NO. 985 IS TO BE EFFECTIVE ONLY UNTIL EFFECTIVE DATE HEREOF. WHEREAS, the City Council did pass and the Mayor did approve Ordinance No. 985 on August 10, 1981, amending Ordinance No. 714, codi- fied as Section 17--90, Kalispell City Code, as an "emergency" ordin- ance; and, following the passage thereof the Mayor did proclaim said Ordinance No. 985 effective in only a part of the total area to be ef- fective thereby due to difficulties experienced in obtaining materials for the proper signing and marking required by said Ordinance No. 985, and all said area is now properly signed and marked; and WHEREAS, a limited study by the Council and City Parking Commis- sion has disclosed that the plan of streets to be effected should be changed somewhat from those designated for two-hour parking in said Ordinance No. 985; and WHEREAS, further study should be conducted of the long range effects of two-hour parking on the streets so designated before a permanent ordinance setting out the two-hour parking plan is adopted; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA: SECTION I. Ordinance No. 714 (codified as Sec. 17-90, Kalis- pell City Code) is hereby amended to read: Sec. 17--90. Overtime parking prohibited; two-hour parking between :9:'00 A.M. and 6:00 P.M. on certain streets. -- A) It shall be unlawful and a violation of the provisions of this article for any person to cause, allow, permit or suffer any vehicle registered in the name of or op- erated by such person to be parked overtime or beyond the period of legal parking time established for any parking meter zone as .herein described. B) It shall be unlawful and a violation of the provisions of this article for any person to permit a vehicle to remain or be placed in any parking space adjacent to any parking meter while such meter is displaying a sig- nal indicating that the vehicle occupying such parking space has already been parked beyond the period pre- scribed for such parking space. C) It is unlawful and a violation of this article for any person -to permit a vehicle to remain parked continu- ously in any individual parking space for more than two hours between.9:00 A.M. and 6:00 P.M. on any day except Sunday or a legal holiday on the following streets: (1) On Main St. between Washington St. and Fifth St.; (2) On First Ave. E. between Center St. and Fifth St. E.; (3) On Second Ave. E. between Center St. and First St. E. and between Second St. E. and Third St. E.; (4) On First Ave. W. between Centex St. and Fifth st� W., (5) On Second Ave. W. between Center St. and Fourth St. W.; 1 (6) On the unnamed street in Depot Park designated "Depot Park Loop" connecting the intersection of First Ave. E. and Center St. with Main St.; (7) On Center St., First St. and Second St. between Second Ave. E. and Third Alley W. 267 1 {8) On Third St. between Third Ave. E. and Third Alley W. (9) On Fourth St. between Second Alley E. and Third Alley W.; (10) On Fifth St. between Second Alley E. and Second Alley W. SECTION II. The Street Superintendent shall immediately in- stall appropriate and adequate signs to indicate parking limits on the streets and avenues effected by this ordinance, and, further, mark individual parking spaces where parking meters have not here- tofor been installed therein. SECTION III. An emergency is hereby declared to exist and a second reading of this ordinance is waived. The facts of the emer- gency are: Expanded on -street parking of vehicles for periods of more than two hours continuously on the streets and avenues des- cribed above has resulted from the city's change of policy relating to public off-street parking lots serving the central business dis- trict of the city. In turn, such expanded on -street long term parking on the above described streets and avenues has resulted in hardship to residents and businesses abutting said streets in gain- ing reasonable access to their properties. Further, the City Council has temporarily suspended enforcement of requiring payment for on -street parking under the Parking Meter Ordinance, Chapter 17, Article V of the City Code, and time to study the effects of such a policy will be required before a permanent ordinance there- fore can be adopted. SECTION IV. This ordinance shall be effective on November 1, 19S1, and for a period of no more than ninety (90) days thereafter. Ordinance No. 985 shall be effective only until this ordinance be- comes effective; thereafter Ordinance No. 985 shall be terminated as is provided by law for emergency ordinances.
