Ordinance 985 - Amends Ord 714 - Extending Two-Hour Parking9 1_ 9 1 1 F_� ORDINANCE NO, 985 AN ORDINANCE TO AMEND ORDINANCE NO, 714.(,SEC. 17-9_00__-KALISRELL CITY CODE) TO EXTEND TWO-HOUR PARKING LIMITATION.TO SECOND AVENUE WEST BETWEEN CENTER STREET AND SECOND STREET WEST, TO SECOND AVENUE EAST BETWEEN CENTER STREET AND THIRD STREET, TO CENTER STREET, FIRST STREET AND SECOND STREET BETWEEN SECOND AVENUE EAST AND THIRD ALLEY WEST, TO FOURTH STREET BETWEEN SECOND AVENUE WEST AND THIRD ALLEY WEST; TO FIFTH STREET BETWEEN SECOND ALLEY EAST AND FIRST AVENUE WEST, AND TO THE "DEPOT PARK LOOP"; TO DECLARE AN EMERGENCY; TO PROVIDE FOR INSTALLATION OF APPROPRIATE SIGNS IN EFFECTED AREAS AND REQUXRE MAYOR TO PROCLAIM ORDINANCE IN FORCE WHEN DONE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RALISPELL, MONTANA; SECTION 1. Ordinance No. 714 (codified as Sec. 17--H, Kalis- pell City Code) is hereby amended to read: Sec. 17-90. Overtime parking prohibited; two-hour parking between 9:00 A.M. and P.M. on certain streets. A). It shall be unlawful and a violation of the provisions of this article for any person -to cause, allow, permit or suffer any vehicle registered in.the name of or op- erated by such person to be parked overtime or beyond the period of legal parking time established for any parking meter zone as herein described. B) It shall be unlawful and a violation of the provisions of this article for any person to permit a vehicle to remain or be placed in any parking space adjacent to any parking meter while such meter is displaying a sig- nal indicating that the vehicle occupying such parking space has already been parked beyond the period pre- scribed for such parking space. C) It is unlawful and a violation of this article for any person to permit a vehicle to remain parked continu- ously in any individual parking space for more than two hours between 9:00 A.M. and 6:00 P.M. on any day except Sunday or a legal holiday on the following streets: (1) On Main St. between Idaho St. and Fifth St.; (2) On First Ave. E. between Center St. and Fifth St. E.; (3) On Second Ave. E. between Center St. and First St. E. and between Second St. E. and Third St. E.; (4) On First Ave. W. between Center St. and Fifth St. W.; (5) On Second Ave. W. between Center St. and Fourth St. W.; (6) On the unnamed street in Depot Park designated "Depot Park Loop" connecting the intersection of First Ave. E. and Center St. with Main St.; (7) On Center St., First St., Second St. and Third St. between Second Ave. E. and Third Alley W.; (8) On Fourth St. between Second Alley E. and Third Alley W.; (9) On Fifth St. between Second Alley E. and First Ave. W. SECTION II. The Street Superintendent shall immediately install appropriate and adequate signs to indicate parking limits on the streets and avenues effected by this ordinance, and, further, mark individual parking spaces where parking meters have not heretofor been installed therein. r SECTION III. An emergency is hereby declared to exist and a second reading of this ordinance is waived. The facts of the emergency are: expanded on -street parking of vehicles for periods of more than two hours continuously on the streets and avenues des- cribed above has resulted from the city's change of policy relat- ing to public off-street parking lots serving the central business district of the city. In turn, such expanded on -street long term parking on the above described streets and avenues has resulted in hardship to residents and businesses abutting said -.streets in gain- ing reasonable access to their properties. SECTION IV. This ordinance will be effective immediately upon public proclamation by the Mayor after proper signing and individ- ual parking space marking has been completed by the Street Superin- tendent as required by Sec. II of this ordinance. This ordinance shall be effective for no more than ninety (90) days following its passage and approval. PASSED BY AN AFFIRMATIVE VOTE OF MORE THAN TWO-THIRDS. ORDINANCE NO. 985 P R O C L A M A T 1 O N WHEREAS, on the loth day of August, 1981, the City Council did pass and I did approve Ordinance No. 985 establishing a two-hour vehicle parking limitation on portions of certain streets in the City; and, WHEREAS, said Ordinance No. 985 was passed as an emergency mea- sure to become effective immediately upon public proclamation by the Mayor after proper signing and individual parking space marking had been, completed by the Street Superintendent; and, WHEREAS, such proper signing and individual parking space mark- ing has been completed on those streets designated for limited park- ing west of Main Street, NOW THEREFORE, I, Norma E. Happ, Mayor, do, pursuant to the power granted me by Ordinance No. 985, hereby proclaim that said Or- dinance No. 985 is immediately effective on the following streets: 1) On Main St. between Idaho St. and Fifth St., 2) On First Ave. W. between Center St. and Fifth St. W., 3) On Second Ave. W. between Center St. and Fourth St. W., 4) On Center St., First St. W., Second St. W., and Third St. W. between Main St. and Third Alley W., 5) On Fourth St. W. between Main St. and Third Alley W., 6) On Fifth St. W. between Main St. and First Ave. W. This proclamation shall be in full force and effect while said Ordinance No. 985 is in effect in accord with Section IV. thereof, or until it is repealed, superceded or amended by other action of the Kalispell City Council.
