AN ORDINANCE TO AMEND THE CITY OF KALISPELL ZONING ORDINANCE (ORDIN-
ANCE NO. 885, AS AMENDED) TO PROVIDE FOR ESTABLISHMENT AND COMPOSI-
TION OF KALISPELL ZONING COMMISSION AND QUALIFICATION REMOVED AND
REPLACEMENT OF MEMBERS; TO PROVIDE THAT THE KALISPELL ZONING COMMIS-
SION ADOPT RULES FOR CONDUCTING ITS MEETINGS AND AFFAIRS AND THAT
CHAIRMAN SHALL HAVE A VOTE;'TO PROVIDE FOR EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA,
AS FOLLOWS:
SECTION I. The first two paragraphs of Sec. #201 of the City
of Kalispell Zoning Ordinance (Ordinance No. 885, as amended) is
hereby amended to read as follows:
For the purpose of this ordinance, certain terms
or words used herein are defined as follows:
All words used in the present tense include the
future tense; and all words in the plural number
include the singular number and all words in the
singular number include the plural number, un-
less the natural construction of the wording in-
dicates otherwise. The word "lot" includes the
word "plot" or "parcel"; the word "building" in-
cludes the word "structure"; the word "shall" is
mandatory and not discretionary. The words "used"
or "occupied" shall include within their meaning.
"intended", "arranged" or "designed" to be used
or occupied. The word "person" shall include a
"corporation", "partnership" or other entity.
Unless otherwise specified, all distances shall
be measured horizontally. The word "city" means
City of Kalispell, State of Montana. The word
"Council" or "City Council" means the City Coun-
cil of the City of Kalispell, State of Montana.
All other provisions of Sec. #2.01 shall remain in full .force and
effect as heretofore enacted and/or amended.
SECTION II. There is hereby enacted a new Sec. #2.02 of the
City of Kalispell Zoning Ordinance (Ordinance No. 885, as amended)
to be added to Chapter 2 thereof and same shall read as follows:
Sec. 2.02. Kalispell_Zoning Commission.
The Kalispell Zoning Commission is hereby
established; same shall consist of five members,
four of whom shall be the city appointed members
of the Kalispell City -County Planning Board duly
appointed and serving in that capacity; a fifth
member shall be an elector of the city and ap-
pointed by the Mayor with the advice and consent
of the Council for a term of three years and he
shall serve until his successor is appointed and
qualified. Said fifth member may be removed for
cause by the Mayor subject to the approval of
the City Council upon written charges made and
served and after a public hearing thereon. A
vacancy in said Kalispell Zoning Commission cre-
ated by the death, resignation or removal of said
fifth member shall be filled by similar appoint-
ment for the unexpired portion of the term of
such retiring member.
The said Kalispell Zoning Commission shall
adopt rules for the orderly and reasonable call-
ing and conduct of its meetings and affairs. The

chairman shall have a vote an all issues. All
members of the Kalispell Zoning Commission shall
serve without compensation.
SECTION III. All other provisions of the City of Kalispell
Zoning Ordinance {Ordinance No. 885, as amendedl shall remain in
full force and effect as heretofore enacted and/or amended.
SECTION IV. This ordinance shall be effective thirty C.301
days from and .after final passage of.same by the City Council and
approval by the Mayor.
