AN ORDINANCE TO AMEND SECTION 2-8, KALISPELL CITY CODE, TO INCLUDE
THE OFFICE OF CITY CLERK -TREASURER AMONG THE APPOINTIVE OFFICERS
OF THE CITY AND ESTABLISH THE TERM THEREFOR; TO AMEND SECTIONS 2-20
TO PROVIDE THAT SAID CITY CLERK -TREASURER SHALL PERFORM ALL DUTIES
HERETOFORE PERFORMED BY CITY TREASURER IN ADDITION TO THOSE IMPOSED
ON THE CITY CLERK; TO AMEND SECTION 2-22, KALISPELL CITY CODE, TO
PROVIDE THAT CITY CLERK -TREASURER PROVIDE BOND IN SUM OF TEN THOU-
SAND DOLLARS; TO REPEAL SECTION 8-5, KALISPELL CITY CODE; TO PROVIDE
EFFECTIVE DATE OF JANUARY 4, 1982, AND THAT INCUMBENT CITY TREASURER
HOLD OFFICE UNTIL THAT DATE.
WITNESSETH:
WHEREAS, Sec. 7-4-4101, MCA, was amended by the 1979 Session
of the Montana Legislature to provide that the City Treasurer in a
First Class City shall be an appointed officer, and
WHEREAS, it is the desire of the Kalispell City Council to com-
bine the functions of the City Treasurer with those of the City Clerk
and establish one appointed officer to discharge the duties thereof,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL, MONTANA, AS FOLLOWS:
Section I. Sec. 2-8, Kalispell City Code, is hereby amended
to hereafter read:
The Mayor shall nominate and by and with.
the consent of the Council, appoint one
City Clerk -Treasurer, one City Attorney,
one Chief of Police, one Engineer, one
City Electrician, and such number of po-
licemen and patrolmen as may be from time
to time established by action of the
Council.
Section II. Sec. 2-20, Kalispell City Code, is hereby amended
to hereafter read:
The duties of the City Clerk --Treasurer
shall be such as are prescribed by Mon-
tana State laws for a City Clerk and a
City Treasurer for a City of the First
Class. The said City Clerk -Treasurer
shall perform those other duties as may
otherwise be set out in the Kalispell
City Code for the City Clerk or the City
Treasurer. The City Clerk -Treasurer so
appointed shall serve until a successor
is appointed by the Mayor and confirmed
by the Council.
Section III. Sec. 2-22, Kalispell City Code, is hereby amended
to hereafter read:
The City Clerk -Treasurer shall file with
the City a bond in the sum of Ten Thou-
sand Dollars, with two sufficient sureties
to be approved by the City Council. The
penalty of the bond of such officer may be
increased or diminished at any time by
Resolution and order of the Council.
Section IV. Sec. 8-5, Kalispell City Code, is hereby repealed_
Section V. Sec. 8-6, Kalispell City Code, is hereby amended
to read_
The City Clerk -Treasurer shall collect all
City license fees that may become due.

Section VI.

Sec. 8-7, Kalispell City Code, is hereby amended
The City Clerk -Treasurer shall, at the
end of each quarter of the fiscal year,
and oftener if required by the. Council,
prepare and deliver to the City Council
a.full and complete report for the said
quarter of all City licenses issued,
giving the name of each person so li-
censed, the type.of license and the
amount paid therefor.
Section VII. All other portions of the Kalispell City Code
relating to the operation of the office of City Clerk and/or City
Treasurer shall remain in full force and effect and the duties as
set forth therein performed as provided hereby.
Section VIII. This ordinance shall be effective on and after
the 4th day of January, 1982.
Section IX. The incumbent City Treasurer, or any person ap-
pointed hereafter to fulfill the unexpired term of the incumbent
City Treasurer, shall hold office until the effective date of this
ordinance..
