AN ORDINANCE TO AMEND THE CITY OF KALISPELL ZONING ORDINANCE TO IN-
CLUDE THEREIN A NEW ZONING DISTRICT TO BE DESIGNATED AS "RESIDENTIAL
R-5S", TO ESTABLISH MINIMUM LOT SIZE THEREFOR, TO LIMIT ESTABLISH-
MENT OF SUCH DISTRICTS TO NEW SUBDIVISIONS OF FIVE ACRES OR MORE
ONLY AND TO PROVIDE FOR MINIMUM AREA FOR SINGLE FAMILY RESIDENCES
THEREIN; PERMITTED AND CONDITIONAL USES IN SUCH NEW DISTRICT SHALL
BE THE SAME AS PROVIDED AND ALLOWED IN A RESIDENTIAL R-5 DISTRICT_,
EXCEPT TWO-FAMILY DWELLING; TO PROVIDE FOR EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA,
THE CITY OF KALISPELL ZONING ORDINANCE IS HEREBY AMENDED AS FOLLOWS:
SECTION I: Chapter 3, Section #3.02(h) is hereby amended to read:
"(h)(.1) Residential' R-5. A residential district with
minimum lot areas. Development within the dis-
trict will require all public utilities, and
all community facilities. Two-family dwell-
ings are permitted in this district.
(2) Residential R-5S. A residential district with
minimum lot areas of 4,400 sq. ft. to provide
for smaller city lots to reduce single family
housing costs. This district will be for new
subdivisions of five (5) acres or more only.
Residential use therein shall be limited to
single family dwelling. Development within the
district will require all public utilities and
all community facilities."
SECTION II: Chapter 3, Section #3.04 "Table of Permitted and Condi-
tional Uses" is hereby amended to include in Table 3-1
under the heading "District Classification" a separate
column headed "R-SS". In the column headed "R-5S"
shall be included all "x" marks designating as Permit-
ted Uses therein the same as are currently contained
in the column headed "R-5" of said chart, except the "x"
for the use of "Dwelling, two family", which shall be
deleted. All "Conditional Uses" presently allowed in
a "R-5" district shall also be allowed in a "R-5S" dis-
trict.
SECTION III: Chapter 3, Section #3.05, "Bulk and Dimensional Re-
quirements", shall be amended to include in Table 3--2
therein the Zoning District of "R-5S", with bulk, di-
mensional and general requirements for such a district.
Said table shall reflect for a "R-5S District" the
same requirements as are presently set forth for a "R-5
District" with the following exceptions:
1) The column headed "Minimum Area (sq. ft.)"
shall reflect "4,400 sq. ft." for the R-5S
District.

2) The column headed "Minimum Living Space
Ratio" shall reflect ".216" for said R-5S
zone.
Chapter 6, Section #6.09.4(b)(.2) is hereby amended to
read:
11(.2) Within the R-4 and R-5 and R-5S (where
allowed) residential districts, detached,
semi-detached and attached.dwellings
shall be permitted."
Chapter 6, Section #6.09.4(c) is hereby amended to add
a new and further subsection which shall read as fol-
lows:

"(6) 4,400 sq. ft. per dwelling unit for any
development within a Residential R-5S
District."
SECTION VI: Chapter 6, Section #6.14(b)(5)(d) is hereby amended
to hereafter read:
"d. PUD Districts created from R-5 or R-5S
Districts shall not exceed ten dwelling
units per acre."
SECTION VII: All other sections of the City of Kalispell Zoning Or-
dinance shall remain in full force and effect.
SECTION VIII: This ordinance is effective thirty days after final
passage and adoption hereof.
