RESOLUTION NO. 39a0
A RESOLUTION TO ABANDON AN ALLEY LOCATED IN BLOCK 23, KALISPELL
ORIGINAL TOWNSITE.
WHEREAS, on the 7th day of June, 1990, the City of Kalispell
received a petition from the City of Kalispell/Hawkins Properties/
Warehouse Industries, Inc. d/b/a Tidyman's, the owners of record of
all the lots and parcels along an alley located in Block 23, requesting
that the City of Kalispell vacate said alley pursuant to Section
7-14-41i4, M.C.A., and
WHEREAS, notice of said petition was published in the Daily
Inter Lake, a daily newspaper, published in Kalispell, Montana on the
10th day of June, 1990, and
WHEREAS, on the 16th day of June, 1990, the City Council of the
City of Kalispell held a public hearing to hear proponents and opponents
on the closure and to further determine any action, that would serve
the public interest, and
WHEREAS, it was determined that the petition.hereinbef ore mentioned
was properly presented to -the Council, and
WHEREAS, it was determined at said public hearing that the closure
of the alley in Block-23, Kalispell Original Townsite, would be in
the public interest.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL, MONTANA, THAT:
SECTION I. That the alley in Block 23, Kalispell Original
Townsite is hereby vacated as the same is no longer required
for public use and the public interest will be served by
its vacation.
SECTION 11. This Resolution shall take effect and be in
force from and after thirty (30) days of its passage and
signature by the Mayor.
PASSED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AND APPROVED BY
