Resolution 3918 - Abandon Mission View Lane390 RESOLUTION NO. 3918 _ A RESOLUTION TO ABANDON A STREET ADJACENT TO NORTHRIDGE HEIGHTS SECTION 3, BLOCK 8, MORE PARTICULARLY DESCRIBED AS MISSION LANE... WHEREAS, on the 15th day of May, 1989, the City of Kalispell received a petition from Jean E. Larson, Hollister A. Larson, Mark S. Miller, Rodney E. Mitchell and Pamela A. Mitchell, the owners of all the lots and parcels;of land along Mission Lane, located adjacent to Northridge Heights Section 3, Block 8, requesting that the City of Kalispell vacate said street pursuant to Section 7-14--4114, M.C.A., and - WHEREAS, notice of said petition was published in the Daily Inter Lake, a daily newspaper, published in Kalispell, Montana on the 30th day of October, 1989, and WHEREAS, on the 6th day of November, 1989 the City Council of the City of Kalispell held a public hearing to hear proponents and opponents on the closure and to further determine any action, that would serve the public interest, and WHEREAS, it was determined that the petition hereinbef ore mentioned was properly presented to the Council, and WHEREAS, it was determined at said public hearing that the closure of the street adjacent to Northridge Heights Section 3, Block 8 would be in the public interest. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA, THAT: SECTION I. That the street adjacent to Northridge Heights Section 3, Block 8, more particularly described as Mission Lane is hereby vacated as the same is no longer required for public use and the public interest will be served by its vacation. SECTION II. This Resolution shall take effect and be in force from and after thirty (30) days of its passage and signed by the Mayor.
