Resolution 3909 - Declare Policies to be Followed by City to Meet EPA StandardsRESOLUTION NO. 3909 A RESOLUTION DECLARING POLICIES TO BE FOLLOWED BY THE CITY OF KALISPELL IN AN EFFORT TO MEET ENVIRONMENTAL PROTECTION AGENCY STANDARDS (PM-10). WHEREAS, on August 7, 1987 the Environmental Protection Agency designated Kalispell as a Group 1 area for the PM-10 standards, and WHEREAS, the Environmental Protection Agency has concluded that fine particulate (PM-10) presents the largest danger to human health because fine particulates can penetrate deeply into oxygen exchanging areas of the lungs and are more difficult for the human body to expel, and WHEREAS, the Kalispell Air Quality Advisory Committee was formed in the Spring of 1987 to monitor and discuss scientific information and to recommend emission control strategies, and WHEREAS, the Kalispell Air Quality Advisory Committee has presented to the City Council a proposed set of Resolutions setting forth policies to be pursued by the City in an effort to meet the PM-10 standard, and WHEREAS, the City Council of the City of Kalispell considers good air quality to be a valuable resource, important to the public health, and essential to the economic well-being of the valley. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION I. MATERIALS TO BE USED ON ROADS AND PARKING LOT; STANDARD. A) The City of Kalispell shall use exclusively, on all city streets and parking lots, sanding and chip seal material which has a durability, as defined by the fine aggregate portion of AASHO T210, of greater than or equal to 80 and has a content of material smaller than 200 mesh, as determined by standard wet sieving methods, which is less than or equal to 3.0% oven dry weight. B) Prior to application, the City of Kalispell shall test the material to demonstrate that the material meets the specifications listed in Section 1 or require the supplier to test the material and provide representative data to the Kalispell public works department demonstrating that the material meets the specifications listed in Section 1. Such data shall be obtained by gathering a representative sample from the supply stockpile or the material as it is produced and analyzing the material in accordance with the methods identified in Section 1. SECTION II. PAVING OF ROADS AND STREETS. A) After January 1, 1990, the City of Kalispell shall not construct a new street, road or alley which is greater than 50 feet, in length and has a projected average traffic volume greater than 50 vehicles per day unless the street, road or 17 alley is paved. B) The City of Kalispell shall not allow the use, operation maintenance of any street, road or alley under city juris- diction which is greater than 50 feet in length, has an average traffic volume greater than 200 vehicles per day, and was in existence on January 1, 1990, unless a plan is in place which provides for paving, routine application of dust suppressants, or other effective measures to control fugitive dust. The plan must be in place by January 1, 1991, and implemented by September 30, 1992. -1- SECTION III. STREET SWEEPING AND FLUSHING. A) DEFINITIONS: (1) "Winter" means the months of November, December, January, February, March, and April. (2) 1°Summer" means the months of May, June, July, August, September and October. (3) "Prioritize street sweeping and flushing" means a schedule of street sweeping and/or flushing which cleans streets with the highest traffic volumes first and proceeds in descending order of traffic volume to streets with the lowest traffic volume. When all ice -free streets have been cleaned, the cycle is immediately repeated. (4) "Reasonably Available Control Technology" means: (i) during winter, prioritized street sweeping and flushing shall commence on the first working day after any streets become either temporarily or permanently ice -free and temperatures are above freezing; (ii) during summer, street sweeping and/or flushing shall be accomplished on an as needed basis with priority given to streets with the highest traffic volumes. B) The City of Kalispell shall not allow the operation, use.or maintenance of any paved road or street unless reason- ably available control technology is utilized. SECTION IV. This Resolution will take effect thirty (30) days from and after passage by the City Council and approval by the Mayor.
