Resolution 3889 - Establishes Comp Time Policy - Non-union EmployeesSECTION IX. Any Non --Exempt Employee, who has accrued compensatory time off, may request the use of compensatory time and shall be permitted such time off within a reasonable period after making the request, provided: A) The request for compensatory time off shall be made in the same manner that requests for vacation time are made, and B) The request for compensatory time off shall be made, when possible, at least two weeks prior to time off, and C) The City may, at its awn discretion, refuse compensatory time off, when such time off would disrupt the City's operation. SECTION X. Regardless of the terms of this Resolution the City, at its option, may compensate Non-exempt Employees with cash in lieu of providing compensatory time off in any work week or work period. Overtime payment in cash, in whole or in part, shall not affect subsequent granting of compensatory time off in future work periods. Payment for accrued compensation time may be made at any time and shall be paid at the regular rate earned by the Non-exempt Employee at the the time said employee receives payment. SECTION XI. In the event a Non-exempt Employee accumulates more than 240 hours limit or the 480 hour limit, whichever is applicable, the non-exempt Employee should be compensated in cash at the one and one-half (1 1/2) rate. SECTION XII. Upon termination of employment, the Non -Exempt Employee shall be paid for unused compensatory time at a rate of canpensation not less than: A) The average regular rate received by such employee during the last three years of three ployee's employment, or B) The final regular rate received by such employee, whichever is higher. SECTION XIII. This Resolution should become effective im-ediately upon passage by the City Council and approval by the Mayor.
