A RESOLUTION APPROVING AN EMERGENCY BUDGET FOR THE GENERAL FUND,
CITY JUDGE, TO COVER A DEFICIT IN SAID ACCOUNT FOR FISCAL YEAR 1989.
WHEREAS, the City of Kalispell in fiscal year 1989 appropriated
$41,737.00 to cover operating the City Judge's office including public
defender, jury and witness fees during said year, and
WHEREAS, for reasons that could not have been reasonably foreseen
at the time of appropriating said amount, the actual cost of operating
the City Judge's office including public defender and jury and witness
fees was $46,737.00, and
WHEREAS, it is estimated that $5,000.00 is required to meet the
emergency, and
WHEREAS, it appears that emergency warrants may be properly
drawn against the General Fund, and
WHEREAS, the City Council of the City of Kalispell pursuant to
Section 7-6-4252, M.C.A., on the 5th day of June, 1989, passed
Resolution No. 3865, and pursuant to said Resolution the City Council
did set a public hearing to be held at 7:30 P.M. on the 19th day of
June, 1989, at the Council Chambers, City Hall, Kalispell, Montana,
and directed the City Clerk -Treasurer to publish notice of said
public hearing in accordance with said section, and
WHEREAS, the City Council pursuant to said Notice did hold a
public hearing at said time and place and provided an opportunity
for taxpayers and residents of the City of Kalispell to be heard for
or against declaring an emergency budget for the General Fund, City
Judge, and
WHEREAS, the City Council at the conclusion of said hearing
determined that it was appropriate to approve the emergency budget
in the amount of 85,000.00 to cover the cost of public defender,
jury and witness fees for the 1989 General Fund, City Judge.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL AS FOLLOWS:
SECTION I. That there exists an emergency in the General
Fund, City Judge, for fiscal year 1989, occasioned by
unanticipated costs of operating the Judge's office resulting
in a fund deficit of approximately $5,000.00.
SECTION II. That the City Clerk -Treasurer of the City of
Kalispell is authorized and directed to issue emergency
warrants which may properly be drawn against the General
Fund to cover the expenditures made because of the emergency.
SECTION III. This Resolution shall become effective imme-
diately upon passage by the City Council and approval by
the Mayor.
SECTION IV. This Resolution shall be entered upon the
minutes of the Council meeting held this date and as such
shall be evidence as compliance with Section 7-6-4252,
M.C.A.
