Resolution 3865 - Sets Public Hearing - Emergency Budget - City JudgeRESOLUTION NO. 3865 A RESOLUTION DECLARING AN E . MERGENCY BUDGET FOR THE GENERAL FUND, CITY JUDGE TO COVER A DEFICIT IN SAID ACCOUNT FOR FISCAL YEAR 1989 AND SETTING A DATE FOR PUBLIC HEARING THEREON. WHEREAS, the City of Kalilspell in Fiscal Year 1989 appropriated $41, 737. 00 to cover operating the City Judge I s of f ice including public defender, jury and witness fees during said year. WHEREAS, for reasons that could not have been reasonably foreseen at the time Of appropriating said amount, the actual cost of operating the City Judge's office including public defender and jury and witness fees was $46,737.00, and WHEREAS, it is estimated thaL '�5,000-00 is required to meet the emergency, and WHEREAS, it appears that emergency warrants may properly be drawn against the General Fund. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION 1. That an emergency appears to exist in the General Fund, City Judge for the Fiscal Year 1989, occasioned by unanticipated rises in the cost of operating the Judge's office resulting in a funddeficitof approximately $5,000.00. SECTION Ii. That a Public Hearing shall be held by the City Council at 7:30 P.M. on the 19th day of June, 1989, at the Council Chambers, City Hall, Kalispell, Montana. SECTION III. That at said hearing any taxpayer or resident of KaTT's—pell may appear and be heard regarding the expenditure of money for the alleged emergency. SECTION IV. That at the conclusion of said hearing the ��o—uncil may, by unanimous vote, declare an Emergency Budget Appropriation to adequately fund the General Fund, City Judge and authorize the expenditure of necessary funds drawn on emergency warrants from the General Fund to meet the emergency. SECTION V. The City Clerk -Treasurer is hereby authorized and directed to publish notice of the above set public hearing by publishing a COPY of the Resolution together with a Notice of Public Hearing in the Daily Inter Lake, said publication to appear on time at least seven (7) days prior to the time set for hearing.
