Resolution 3858 - Set Public Hearing - Amend BudgetRESOLUTION NO. 3858 A RESOLUTION SETTING A DATE FOR A PUBLIC HEARING ON AMENDING THE FISCAL 1989 BUDGET FOR THE GENERAL FUND TO PROPERLY ACCOUNT FOR THE REDEMPTION OF TAX DEED LAND. THE SPECIFIC PROPERTY IS LOTS 4, 5, 6, 7, 8, 9, 12, 13, 16, 17, 18, 19, 20, 21, BUFFALO HEAD SUBDIVISION. WHEREAS, the actual expenditure for the purchase of tax deed land is $79,594.71, and WHEREAS, the expenditure is to be covered by revenue anticipated from the sale by the City of such property. The anticipated revenue is $211,122.59 for the sale of such property. The difference of $131,527.88 will be appropriated and transferred from the General Fund to the SID 328 Debt Service Fund to pay off SID Bonds, and WHEREAS, the purpose for the purchase of the tax deed land is to protect our interest in SID Bonds, which are an annual obligation of the City. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION I. That the actual expenditures for the purchase of tax deed land in the General.Fund is $79,594.71. SECTION II. That the General Fund budget may be legally amended to authorize the expenditure of $79,594.71 from revenue anticipated from the sale of property. SECTION III. That a Public Hearing shall be held by the City Council at 7:30 P.M. on the 5th day of June, 1989, at the Council Chambers, City Hall, Kalispell, Montana. SECTION IV. That at said hearing any taxpayer or resident of Kalispell may appear and be heard regarding the proposed budget amendment. SECTION V. That at a meeting held at least seven (7) days subsequent to said hearing the Council may, by majority vote, amend the General Fund to properly account for expen- ditures. SECTION VI. The City Clerk -Treasurer is hereby authorized and directed to publish notice of the above set public hearing by publishing a copy of the Resolution together with a Notice of Public Hearing in the Daily Inter Lake, said publication to appear on time at least six (6) days prior to the hearing on the budget amendment. That the City Clerk -Treasurer of the City of Kalispell shall give immediate notice of the passage of this Resolution by notifying in writing all owners and purchasers under contract for deed of property in the terri- tory, addressed to the address to which tax notices are sent, of the passage of this Resolution in the Daily Inter Lake once a week for two successive weeks. SECTION IV. That the notice herein ordered published shall state that this Resolution has been duly and regularly passed and that for a period of twenty (20) days after the first publication said Clerk -Treasurer will receive expressions of approval or disapproval, in writing, from the freeholders within the territory to be annexed except that, in accordance with Section 7-2-4502, MCA, the territory shall be annexed, upon passage of a Resolution of Annexation, whether or not a majority of the resident freeholders in the territory object. SECTION V. That at the next regularly scheduled meeting of the City Council after the expiration of the twenty (20) days of Section IV, supra, the City Clerk -Treasurer shall lay before the City Council all communication in writing received by him for said Council's consideration. SECTION VI. That if after considering the comments made the Council shall duly and regularly pass and adopt a Resolution of Annexation, the boundaries of the City of Kalispell shall be extended so as to embrace and include said territory, upon date fixed in said Resolution of Annexation. ""enned Jr., Mayor EXHIBIT "A" A tract of land in Government Lots 6 and 7 of Section 6, Township 28 North, Range 21 West, M.P.M., Flathead County, Montana described as follows: Beginning at the Northwest corner of the Resubdivision of. Kalispell Medical Arts Additiion No. 35; thence South 3013' West a distance of 160.00 feet to the Northeast corner of Addition No. 14 to Kalispell; thence North 86055' West a distance of 332.04 feet to the East boundary of U.S. Highway No. 93; thence North 15143' West along the East boundary of U.S. Highway No. 93 to the South boundary of Sunnyview Lane; thence East along the said boundary to the point of beginning. EXHIBIT "B" SUNNYVIEW ADDITION GENERAL DESCRIPTION: This property has frontage on both U.S. Highway 93 and Sunnyview Lane. It is residential in character. The surrounding uses include mostly hospital and medical facilities. EXISTING SERVICES: Water: A 12 inch water main is available near the northeasterly and easterly portions of the property. Sewer: An eight (8) inch sewer main follows along Sunnyview Lane and down U.S. Highway 93. Storm Drainage: A 15 inch storm drain system is in place along the westerly portion of the property along U.S. Highway 93. Streets: The property has frontage along U.S. Highway 93 and along Sunnyview Lane. Garbage Collection: Garbage collection is available on a contract basis to the property from private companies. Police Protection: Police jurisdiction is with the Flathead County Sheriff's Department. Fire Protection: Fire jurisdiction is with a rural Fire District. ANTICIPATED SERVICE NEEDS: Water: All but a portion of the westerly property can be served with the existing water mains. A water main extension will be necessary to serve the westerly portion of the property. Sewer: The existing sewer main can adequately serve the property. No extension of sewer mains will be necessary. Storm Drainage: It may be possible to service the property with the existing storm drainage system found along U.S. Highway 93. Streets: The property currently has frontage along two public streets. Highway access is not guaranteed. No additional public. roads will be necessary to provide access to the property. Garbage Collection: The City of Kalispell will not provide Solid waste disposal service to the annexed territory for a period of at least five (5) years, consistent with the provision of 7-2--4736, M.C.A. Police Protection: Police protection will be the responsibility of the city upon annexation. Fire Protection: Fire protection will be the responsibility of the city upon annexation. EXTENSION AND FINANCE STRATEGIES All city services will be available to the property upon annexation. The cost of extending such public services as police and fire protection will be borne by the entire municipality through city tax revenues. Individual connection to water and sewer mains as well as the storm drainage system will be the responsibility of the landowners in accordance to existing city policies. The entire municipality will also share the tax burden for most of the street maintenance program. Individual improvements to the neighborhood relative to the storm drainage and lighting will be financed in part by the residences of the entire municipality and in part by special assessments for that purpose.
