BACKGROUND: Pursuant to MCA 7-5-4401, the four city wards, for election and other purposes,
must "have regard to population so as to make them as nearly equal as possible." Census 2020
population figures for the City of Kalispell have been published and show that the population has
changed and shifted such that the existing boundaries of the wards no longer contain populations that
are nearly as equal as possible. The City Development Services Department, using the Census 2020
population figures and GIS software, analyzed the data and modified the ward maps by adjusting the
ward boundaries as little as possible to correct the population differences between the wards. Attached
to this memorandum is a copy of the controlling state statute referred to above as well as maps
showing the ward populations and boundaries established by the Census 2010 data compared to the
populations and boundaries established by the Census 2020 data. The City Council discussed the
proposed map during the November 22, 2021 work session meeting.
RECOMMENDATION: It is recommended that the Council approve the first reading of Ordinance
1869, an ordinance amending ordinance 1706 codified as Section 6-1 of the Kalispell City Code by re-
establishing the boundaries of the wards of the city based upon Census 2020 population figures and the
mandate of state law at Section 7-5-4401 Montana Code Annotated.

7-5-4401. Division of municipalities into wards. (1) The first city or town council elected under the
provisions of this title must divide the city or town into wards for election and other purposes, having
regard to population so as to make them as nearly equal as possible.
(2) (a) Cities of the first class must be divided into not less than four or more than 10 wards.
(b) Cities of the second class must be divided into not less than three or more than six wards.
(c) Cities of the third class must be divided into not less than two or more than four wards.
(d) Towns must be divided into not less than two or more than three wards; provided, however, that
the town council may by ordinance reduce the number of wards in a town to only one if it so desires.
(3) All changes in the number and boundaries of wards must be made by ordinance. No new ward
must be created unless there shall be within its boundaries 150 or more electors.

ORDINANCE NO. 1869
AN ORDINANCE AMENDING ORDINANCE NO. 1706 CODIFIED AS SECTION 6-1 OF
THE KALISPELL CITY CODE BY RE-ESTABLISHING THE BOUNDARIES OF THE
WARDS OF THE CITY BASED UPON CENSUS 2020 POPULATION FIGURES AND
THE MANDATE OF STATE LAW AT SECTION 7-5-4401 MONTANA CODE
ANNOTATED.
WHEREAS, pursuant to Section 7-5-4401 MCA, the four city wards, for election and other
purposes, must have regard to population so as to make them as nearly equal as
possible; and
WHEREAS, Census 2020 population figures for the City of Kalispell have been published and
show that the population has changed and shifted in the city such that the existing
boundaries of the wards no longer contain populations that are nearly as equal as
possible; and
WHEREAS, the City Planning Department, using the Census 2020 population figures and GIS
software, has analyzed the data and modified the ward maps by adjusting the ward
boundaries as little as possible to correct the population differences between the
wards, said map attached hereto and incorporated herein by this reference; and
WHEREAS, the Kalispell City Council hereby finds that the adjustments to the ward map, as
drafted by the City Planning Department, adequately and appropriately divides the
city into four wards with populations nearly equal as possible.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA,
THAT ORDINANCE NO. 1706, CODIFIED AT SECTION 6-1 OF THE CITY CODE BE
AMENDED AS FOLLOWS:
SECTION 1. The territory embraced within the limits of the City shall be and the same is
hereby divided into four wards, bounded and described as hereinafter set
forth and as shown on the map attached hereto and incorporated fully herein
by this reference.
A. Ward No. 1: Shall consist of all that territory within corporate limits of the City of
Kalispell, lying northerly of U.S. 2 West, westerly of North Meridian Road and
U.S. 93 North to Four Mile Drive, southerly of Four Mile Drive to the Alternate
Highway 93, westerly of Alternate Highway 93 to the intersection with U.S. 93
North, and westerly of U.S. 93 North to the Stillwater River.
B. Ward No. 2: Shall consist of all that territory within corporate limits of the City of
Kalispell, lying northerly of a line described as being West and East Center Street
to Woodland Avenue; thence southerly along Woodland Avenue to Sylvan Drive,
easterly of South/North Meridian Road and U.S. 93 North to Four Mile Drive,
northerly of Four Mile Drive to Alternate Highway 93, easterly of Alternate
Highway 93 to U.S. 93 North, and easterly of U.S. 93 North to the Stillwater River,
including all land northerly from that point.
C. Ward No. 3: Shall consist of all that territory within corporate limits of the City of
Kalispell, lying southerly of a line described as of U.S 2 West, westerly of South
Meridian Road to the intersection of West Center Street; thence easterly along West
and East Center Street to Woodland Avenue; thence southerly along Woodland
Avenue to Sylvan Drive, and northerly of a line described as being the easterly
extension of loth Street East to Woodland Avenue; thence northerly along
Woodland Avenue 915 feet; thence easterly 610 feet to the intersection of Concord
Lane, and running westerly along 1 Oth Street East and 101h Street West to 81h Avenue
West; thence northerly on 81h Avenue West to 9th Street West.
D. Ward No. 4: Shall consist of all that territory within corporate limits of the City of
Kalispell, lying southerly of a line described as being the easterly extension of loth
Street East to Woodland Avenue; thence northerly along Woodland Avenue 915
feet; thence easterly 610 feet to the intersection of Concord Lane, and running
westerly along loth Street East and loth Street West to 8th Avenue West; thence
northerly on 8th Avenue West to 9th Street West, and the westerly extension of 9th
Street West to Alternate Highway 93.
SECTION 2. As there are additions made to the corporate limits of the City of Kalispell,
the aforesaid boundary lines of the respective wards shall be extended in a
Southerly, Northerly, Easterly or Westerly direction, as the case may be,
along the center line of the nearest extended street running Southerly,
Northerly, Easterly, or Westerly, as the case may be, to the City limits.
SECTION 3. This Ordinance shall be effective thirty (30) days from and after the date of
its final passage and approval.
