Resolution 3776 - Annexation - LeDuc Add 209RESOLUTION NO. 3776 A RESOLUTION TO PROVIDE FOR THE ALTERATION OF THE BOUNDARIES OF THE CITY OF KALISPELL BY INCLUDING THEREIN, AS AN ANNEXATION, CERTAIN REAL PROPERTY LOCATED IN AND ON LOTS 1, 2, 7, 8, 9, 11 AND 12 OF THE LEDUC ADDITION, FLATHEAD COUNTY, MONTANA, AS IS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A", TO BE KNOWN AS THE LEDUC ADDITION NO. 209, TO ZONE SAID PROPERTY RESI➢ENTIAL, R-2, IN ACCORDANCE WITH THE KALISPELL ZONING ORDINANCE, AND TO AMEND THE CITY ZONING MAP ACCORDINGLY. WHEREAS, on the 23rd day of November , 1987 lst Interstate Bank of Kalispell, N.A., as Trustee of the Amended Maxey Trust, petitioned the City of Kalispell to annex certain real property which is more fully described in Exhibit "A", attached hereto and for purposes of this Resolution made a part hereof, into the City of Kalispell, and WHEREAS, the Kalispell City -County Planning Board and Zoning Commis- sion at its regular held meeting on December 8, 1987 considered said petition to annex and the request made by the petitioner to zone said property Residential, R-2, in accordance with the Kalispell Zoning Ordinance, and WHEREAS, in accordance with Section 6.13 of the Kalispell City Zoning Ordinance, the City Clerk -Treasurer gave notice of the petition for annexation and request to zone said property Residential, R-2, in accordance with the Kalispell Zoning Ordinance, and WHEREAS, the City Council of the City of Kalispell held a Public. Hearing on said proposed zoning request at its regularly scheduled meeting held February 1, 1988, at the Council Chambers, City Hall, Kalispell, Montana, and WHEREAS, the property proposed for annexation is contiguous to the existing city limits of the City of Kalispell, and WHEREAS, the petition for annexation is signed by the owner of the property, and the petition can be approved by the City Council under Section 7-2-4601, et seq, Montana Code Annotated, and WHEREAS, no part of the property proposed for annexation is used for agricultural, mining, smelting, refining, transporation, or any industrial or manufacturing purpose or any purpose incident thereto, and WHEREAS, the property proposed to be annexed is included within and conforms to the City -County Master Plan, and WHEREAS, the proper zone for said property is Residential, R-2, in accordance with the Kalispell Zoning Ordinance and the Kalispell City -County Master Plan; and WHEREAS, the effective date of this annexation should be thirty (30) days next succeeding the final passage of this Resolution and approval by the Mayor. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CTTY OF KALISPELL AS FOLLOWS: SECTION I. The real property as is more particularly described in Exhibit "A", attached hereto, shall be annexed to the City of Kalispell and the boundaries of the City are hereby altered to so provide. SECTION II. That the City Clerk -Treasurer of the City of Kalispell -is authorized and directed upon the effective date of this Resolution, which is thirty (30) days next succeeding the passage of this Resolution and signature by the Mayor, to make and certify under Seal of the City a copy of the record of these proceedings as are entered on the minutes of the City and file said document with the Flathead County Clerk and Recorder upon or after the effective date hereof. 1 1 SECTION III. From and after the filing date of said documents in the o ice of the Flathead County Clerk and Recorder or the effective date of this Resolution, whichever is later, said annexed territory is part of the City of Kalispell and said territory and its citizens and property shall be subject to all debts, laws and ordinances and regulations in force in the City of Kalispell and shall be entitled to the same privileges and benefits as are other parts of the City. SECTION IV. All of said property so annexed to the City" shall be zoned in accordance with the Kalispell Zoning Ordinance and is hereby zoned Residential, R-2. SECTION V. This Resolution shall be effective thirty (30) days rom and after its final passage and approval by the Mayor.
