A RESOLUTION CONDITTONALLY APPROVING THE AMENDED PLAT OF LOT 1 OF
BECKER'S ADDTTTON, KALISPELL, FLATHEAD COUNTY, MONTANA.
WHEREAS, Helen Becker., by and through J. H. Burton, the owner of a
portion of Lot 1, Becker's Addition, Kalispell, Flathead County,
Montana, have petitioned for approval of the resubdivision of Lot 1,
Becker's Addition, Kalispell, Flathead County, Montana, to be known
as Amended Plat of Lot 1, Becker's Addition, Kalispell, as is more
particularly described in Exhibit "A", attached hereto and for purposes
of this Resolution :Wade a part hereof, and
WHEREAS, the Amended Plat of Lot 1, Becker's Addition, is entitled
to summary review under Section 2.7(A)(1), Subdivision Regulations of
the City of Kalispell, and
WHEREAS, the Flathead Regional Development Office has reviewed the
proposed subdivision and authored a report considering and weighing
all public interest criterion set forth in Section 2.2(F)(3), Subdivision
Regulations of the City of Kalispell, and
WHEREAS, the City Council of the City of Kalispell has had an
opportunity to review the report of the Flathead Regional Development
Office and has found that from the preliminary plat, and evidence,
that the subdivision is in the public interest, and
WHEREAS, the City Council of the City of Kalispell has based its
public interest findings upon the following finding of fact:
A. EFFECTS ON PUBLIC HEALTH AND SAFETY:
1. Police Protection: This service is available from the
Kalispell Police Department. This two lot subdivision can
be adequately served by said Department and the Department
can provide quick response to any emergency.
2. Medical Services: Routine medical facilities are available
in Kalispell as well as emergency services. Again quick
response to medical emergencies is available from the medica_1
personnel of the fire department.
3. Fire Protection: Quick response will be available from
the Kalispell Fire Department for any fire emergencies that
might be associated with the subdivision.
4. Traffic: One additional residential lot should not
create or otherwise aggravate problems with traffic safety
in the general area. The existing road network can adequately
accommodate the 6-12 daily vehicle trips that might be generated
by the additional residence(s).
5. Natural Environment: The property exhibits few, if any,
inherent ris s to public health and safety. Flooding, earth-
quakes, and other similar natural hazards are unlikely.
B. EFFECTS ON WILDLIFE AND WILDLIFE HABITAT:
The lot division will not have a direct impact on wildlife
or wildlife habitat. The subject property and surrounding
properties are committed to high density development.

C. EFFECTS ON THE NATURAL ENVIRONMENT:
The land division will have a minimal effect on the natural
environment. The subdivision will be served by municipal
water and sewer facilities. Runoff will not directly enter
any surface water. No plant communities or other significant
natural features will be lost with development of the additional
lot.
D. EFFECTS ON TAXATION:
Property taxes on Lot 1 with the house is currently $613
including special assessments.\ Following subdivision, Lot
lA with the house will be assessed approximately $655. The
vacant lot will be assessed approximately $204. The additional
revenue that might be realized with future improvements to
the vacant lot will probably be deficient to fully compensate
the cost of provided public services.
E. EFFECTS ON LOCAL SERVICES:
1. Schools: Less than "three _students °are like2':v to be
associatewith the two lots. Younger students will attend
Hedges School unless a particular class is at capacity, in
which case, students will be bused to another school. This
particular subdivision should not create any particular hard-
ship to the school district.
2. Parks and Recreation: No parkland dedication is required
for a subdivision that creates one additional lot. Sufficient
city park areas are available to accommodate the residents
of the anticipated additional dwelling.
3. Emergency Services: This two lot residential subdivision
can be s rved by the existing staff and facilities of the
Kalispell Police and Fire Departments. The subdivision will
not create an undue demand for these services.
4. Roads: The subdivision will not overburden the existing
street system nor should it significantly contribute to road
deterioration.
5. Water/Sewer: Water and sewer services will be provided
to one additional lot. Again, this should have a minimal
effect on the capacity of those utilities. Of particular
note, the plat indicates that Lot lA is served by sewer from
the middle of Lot 1B. This may effect the siting of a
future dwelling on the property.
F. EFFECTS ON AGRICULTURE:
Agriculture will not be affected directly or indirectly by
this subdivision. The subject property and surrounding pro-
perties are committed to urban -type uses.
G. EXPRESSED PUBLIC OPINION: The summary review procedures
of the Kalispell Subdivision Regulations do not require public
notification of the proposed subdivision. As such, no comments
have been solicited and, accordingly, none have been received.
H. NEED FOR SUBDIVISION: The subdivision will create one
additional city lot that is easily amenable to development.
Furthermore, the lot can be sold for development of single
family or multiple family dwellings. From a marketing stand-
point, this lot is very marketable but it is doubtful that
the additional lot satisfies any "unmet" demand.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, MONTANA:
SECTION I. That the application of Helen Becker for approval
of Amended Plat of Lot 1, Becker's Addition, Kalispell,
Flathead County, Montana, a proposal to create one additional
lot on a portion of Lot 1, Becker's Addition, Kalispell,
Flathead County, Montana, as described in Exhibit "A", is
hereby approved subject to the following conditions:
1. That a city approach permit from Fourteenth Street East
be obtained as appurtenant to Lot 1B.

2. That all water and sewer utility extensions necessary to
serve each lot be built to city specifications.
3. That the size, dimension, and area of lots not constitute
the basis for any variance from the bulk and dimensional
requirements of the zoning district that may be needed for
future development of the lots.
4. That certification pertaining to water supply, sewer and
solid waste disposal be obtained prior to final plat approval.
SECTION II. The classification of said premises under the
Kalispe l Zoning Ordinance shall not be changed by the action.
SECTION III. That this preliminary plat should be effective
for a period of three years following passage of this
Resolution.
SECTION IV. That upon proper review and filing of the final
Flat of said subdivision in the office of the Flathead County
Clerk & Recorder, said premises shall be a subdivision of
the City of Kalispell.

A RESOLUTTON OF INTENTION TO IMPLEMENT ORDINANCE NO. 1110 (THE KALTSPELL
ZONING ORDTNANCE) RESULTING IF; A REDUCTION TN THE NUMBER OF ZONING
CLASSTFICATIONS APPLICABLE WITHIN THE CITY OF KALISPELL.
WHEREAS, on the 19th day of October, 1987, the City Council of the
City of Kalispell passed Ordinance No. 1110 entitled "AN ORDINANCE TO
PROVIDE FOR COMPREHENSIVE REVISIONS TO THE KALISPELI'ZONTNG ORDTNANCE,
TO PROVIDE UNIFORMITY TO CERTAIN PROCEDURES U14DER THE BOARD OF ADJUST-
MENT, CONFORM NON -CONFORMING USE PROVTSTONS, REPEAL ORDINANCES NOT
CONSISTENT HEREWITH, AND TO PROVIDE AN EFFECTIVE DATE", and
WHEREAS, Ordinance No. 1110 reduces- thy -number cE zoning classifi-
cations within the City of Kalispell from approximately 32 to lb by
blending zones in existence in the Downtown Redevelopment Area with
zones applicable in areas not encompassed by the redevelopment bound-
aries, and
WHEREAS, reduction in number of zones will not result in fewer
permitted or conditional uses, nor will the reduction result in boundary
changes in the Official Zoning Map of the City of Kalispell, and
WHEREAS, the City Council may by resolution apply Ordinance No.
1110 to property within the City Limits after the Zoning Commission
holds a public hearing on the proposed application, and
WHEREAS, the Kalispell City -County Planning Board & Zoning Commission
has scheduled a public hearing on the application of the Ordinance to
property within the City Limits at 4:30 P.M. on December 22, 1987,
and
WHEREAS, following said Public Hearing the Kalispell City -County
Planning Board & Zoning Commission shall make recommendations to the
City Council concerning the zoning districts most adaptable to said
propert-y and the City --Council must consider the recommendations made
by the Zoning Commission.
NOW THEREFORE BE IT RESOLVED .BY THE CITY COUNCIL OF THE CITY OF
KALISPELL AS FOLLOWS: _
SECTION I. That the City Council intends to take under
consideration at the meeting to be held on January 4, 1988,
the recommendations on the implementation of Ordinance No.
1110 (Kalispell Zoning Ordinance) and at said meeting shall
adopt a Resolution applying Ordinance No. 1110 to property
within the City Limits of the City of Kalispell.
SECTION II. The City Clerk -Treasurer is directed to give
notice of the passage of this Resolution by publishing notice
of the same in the Daily Inter Lake on the 23rd day of
December, 1987 and the 30th day of December, 1987.
