A RESOLUTION TO ABANDON A PORTION OF 4TH AVENUE WEST BETWEEN 4TH
STREET WEST AND 5TH STREET WEST, AS IS MORE PARTICULARLY DESCRIBED AS
THAT PORTION OF 4TH AVENUE WEST LYING EAST OF THE EASTERLY PROPERTY
LINE OF LOTS 1 THROUGH 4, BLOCK 11, KALISPELL, FLATHEAD COUNTY,
MONTANA .
WHEREAS, on the loth day of June, 1987, the City of Kalispell
received a petition from Flathead School District No. 5 and the Mayor
Of the City of Kalispell, the owners of record of more. than 75% of
the lots and parcels along 4th Avenue West between 4th Street West
and 5th Street West, requesting that the City Council of the City of
Kalispell vacate said street pursuant to Section 7-14-4114, M.C.A.,
and
WHEREAS, notice of said petition was published in the Daily Inter
Lake, a daily newspaper, published in Kalispell, Montana, on the 22nd
day of June, 1987, and the 29th of June, 1987, and
WHEREAS, on the 6th day of July, 1987, the City Council of the
City of Kalispell held a public hearing to hear proponents and opponents
on the closure and to further determine any action, that would serve
the public interest, and
WHEREAS, it was determined that the petition hereinbefore'mentioned
was properly presented to the Council, and
WHEREAS, it was determined at said public hearing that the closure
of a portion of said avenue would be in the public interest.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, MONTANA, THAT:
SECTION I. That that portion
of 4th Avenue West
lying East
of the Easterly property line of Lots 1 through 4,
Kalispell, Flathead County, Montana, is hereby
Block 71,
vacated as
the same is no longer required
for public use and
the public
interest will be served by its
vacation.
SECTION II. This Resolution
shall take effect
and be in
force rom and after thirty
(30) days of its passage and
signed by the Mayor.
