Resolution 3711A - Carver Engineering Contract Amendment, IT, S0LLT10N N0. :3'.1A 1 1 A RESOLUTTON TO ALTER AND AMEND THE PLANS AND SPECIFICATIONS OF CONTRACT WTTH Carver Engineering, Inc. ON Woodland Sewer Project Contractor Project WHEREAS, the City did, on June 10, 1985 enter into a Date contract with Carver Engineering, Inc. Contractor of 720 Second Street East, Kalispell, MT 59901 Address f or engineering for lift station and sewer mains Description of Work on the Woodland Sewer Project ; and Project WHEREAS, upon the advice and recommendation of Dennis F. Carver who is the City's consultant and Engineer or Architect engineer on said project, certain changes and alterations of design and specifications have been found necessary and adviseable and in the best interests of the City; and said changes and alterations could not have been necessarily forseeable when the original design and specifications were prepared on this phase of the Woodland sewer Project and said changes are contained in Exhibit Project A attached hereto and are by this reference made a part hereof; and WHEREAS, it appears in the best interests of the City to approve said changes and alterations, NOW THEREFORE, pursuant to the provisions of Section 7-5-4308(l) MCA be it hereby resolved: 1. The alterations and modifications of the specifications and plans of the contract between the City of Kalispell and Carver Engineering, Inc. , dated June 10, 1985 Contractor as set out in Exhibit A attached hereto, are hereby approved; and f 2. As soon as the price to be paid for said alterations and modifications are agreed to in writing, signed by the contractor, as hereby approved by the Council, this approval thereof shall be in effect. (ENGINEER) DATE: JANUARY 19, 1987 In accordance with the Agreement dated June 10, 1985, authorization to proceed with Items B-9 through B-22 for Engineering Services During the Construction Phase (EPA Step 3 Work) for the Woodland Sewer Project (SID No. 337) is required. Carver Engineering, Inc., is hereby authorized to proceed as noted above. Compensation shall be in accordance with the EPA Form 5700--41 as attached and as stated in SECTION E - COMPENSATION FOR STEP 3 ENGINEERING SERVICES of the Agreement. As stated in SECTION E, the cost ceiling of $26,806.92 may not be exceeded without amendment, and the fixed profit amount of $2,905.79 may not changed without a change in scope of services and an amendment to the Agreement. Authorization is also given to proceed with SECTION C, ADDITIONAL SERVICES, for preparation of an Operation and Maintenance Manual and for Project Certification. Compensation shall be by the cost plus fixed fee method as estimated on the attached EPA Form 5700-41. The cost ceiling of $3,956.82 may not be exceeded without amendment and the fixed profit amount of $500.39 may not be changed without a change in scope of services and an amendment to the Agreement. 11 CARVER ENGINEERING, INC.
