A RESOLUTION RELATING TO THE ACQUISITION OF CERTATN PROPERTY LOCATED
WTTHTN THE CITY OF KALISPELL, IDENTIFYING THE PERSONS WHO APPEAR TO
HAVE AN OWNERSHIP INTEREST, ESTABLISHING FAIR MARKET VALUE, TDENTIFYTNG
THE INTEREST TO BE ACQUIRED, AND CERTIFYING THAT THE WORK OF THE
APPRAISER HAS BEEN PERFORMED IN A COMPETENT MANNER.
WHEREAS, on the 4th day of November, 1935, the City Council of the
City of Kalispell passed Ordinance No. 1065 approving certain Urban
Renewal Projects to be undertaken by the City of Kalispell, pursuant
to Title 7, Chapter 15, Parts 42 and 43, Montana Code Annotated and
Ordinance No. 933, and
WHEREAS, one of the Urban Development Projects approved by said
Ordinance No. 1065 was the acquisition of land for a neighborhood
park adjoining Elrod Grade School on Lots 1-6, Block 71, Kalispell
Original Townsite, and
WHEREAS, on the 2nd day of June, 1986, the City Council of the
City of Kalispell adopted Resolution No. 3659 which authorized the
Community Development Department and the Community Development Committee
of the City of Kalispell to obtain proposals from local appraisers,
employ an appraiser to appraise said Lots, review the appraisals and
recommend to said Council a fair market value on each individual
parcel, and
WHEREAS, the Community Development Department and the Community
Development Committee have caused appraisals to be made on each indivi-
dual. Lot by Roger Jacobson, a MAI Real Estate Appraiser, and
WHEREAS, Roger Jacobson has prepared his report on each individual
Lot, and
WHEREAS, the Community Development Committee has received the
appraisals submitted by Roger. Jacobson and has made recommendations
concerning the fair market value of -said property.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL AS FOLLOWS:
SECTION 1. That the Community Development Committee shall
a ter review of the appraisals with Roger Jacobson establish
the fair market values.
SECTION IT. That the creation of West Side Park will require
the acquisition of a fee simple estate in the name of the
City of Kalispell from the owners of the respective property
by Warranty Deed.
SECTION III. That the work of the Appraiser, Roger Jacobson,
MAT, with respect to the property has been performed in a
competent manner in accordance with State law and his fee of
$5200.00 is approved.
SECTION IV. That the Community Development Committee, by
and through its agent, the Community Development Department,
is authorized to enter into negotiations with the respective
owners of the property to acquire the property at the fair
market value as established by the Community Development
Committee and in accordance with Ordinance No. 1065 and
Resolution No. 3659.
SECTION V. This ordinance shall.become effective from and
after the date of its passage and approval by the Mayor.
