Resolution 3704 - Preliminary Plat - Roberts AdditionM RESOLUTION NO. 3104 1 1 1 A RESOLUTION CONDITIONALLY APPROVING THE PRELIMINARY PLAT OF LOT 1, ROBERTS ADDITION #132. WHEREAS, Don Frownfelter, the owner of a tract of land, to wit: Lot 1, Roberts Addition #132, Kalispell, Flathead County, Montana, more particularly described in Exhibit ''A", on the 4th day of October, 1986, made an application to subdivide said property, and WHEREAS, the Flathead Regional Development Office reviewed said application and submitted a report on the proposed subdivision on the 27th day of October, 1986, and WHEREAS, the proposed subdivision is a minor subdivision under the provisions of §76-3-505, M.C.A., and is entitled to summary review under §2.7 of the City of Kalispell, Subdivision Regulations, and WHEREAS, the owner presented the Preliminary Plat of said subdivision for review by the City Council at its regularly scheduled Council meeting held on the 17th day of November, 1986. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION I. The preliminary plat of Lot 1, Roberts Addition T132, is hereby approved, and as serving the public interest, and the name shall be known as Lot 1, Roberts Addition #132, subject to the following conditions: 1. That connection and/or extension to the City water, sewer or storm drain system be accomplished at the subdivider's expense and in accordance to plans approved by the Director of Public Works. 2. . That curbs fronting the property be reconstructed in a manner acceptable to the Director of Public Works following construction of the driveway access to each lot. 3. That certification pertaining to water supply, sewers,,and solid waste disposal, be obtained before final plat approval. 4. That all delinquent tax assessments applicable be paid prior to final plat approval. 5. That the size, dimension and area of lots not constitute the basis for any variance from thebulk and dimensional requirements of the zoning district that may be needed for future development of the lots created. SECTION II. Park dedication shall not be required because the property is subject to exception contained in Section- 76-3-606(3), M.C.A. SECTION III. The classification of premises under the Kalispell Zoning Ordinance not be changed by this action. SECTION IV. Upon proper review and filing of the final plat of said subdivision in the office of the Flathead County Clerk and Recorder, said property shall be a subdivision of the City of Kalispell. PASSED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AND APPROVED BY THE MAYOR THIS 17TH DAY OF NOVEMBER, 1986.
