SE3=0N 6, TOWNSHIP 28 NORTH, RANGE 21 WEST, P.M.M., FLATHEAD COUW-Y, MONTANA, AS IS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A", TO BEKN06N AS THE IMMANUEL LUTHERAN HOME ADDITION NO. 196, TO ZONE SAID 7W.ERTY AS RESIDENTIAL APARTMENT, RA-2, AND TO AMEND THE CITY ZCRTNG MAP ACCORDINGLY. WHEREAS, Spencer H. Ryder and Alice J. :Ryder, the mma2r�a- of a tract of land described in Exhibit "A", req :ested on the I-st day of u July, 1986, that the City Council of the City of KalisWII mnsidem the annexation of certain real property situated outside the baundaries of the City of Kalispell, but contiguous thereto, and WHEREAS, the City Council on the 2nd day of September, 119ft,pAsSE4 Resolution No. 3686, declaring an intention' to annex w_m-ndh real property, described above, to the City of :Kalispell; ana TFrsuapl, thereto the City Council did set a Public Hearing to ba- Ulelh o* tlx- annexation and due and proper notice of said :Public Hearing ,Xas givera by the City Clerk -Treasurer; and WHEREAS, the City Clerk -Treasurer received expressiom Jx.�writing of approval or disapproval of the proposed e#ension of the -kundaries of the City of Kalispell from the freeholders of the territca-y:proposed to be embraced therein; and WHEREAS, on the 6th day of October, 1986P the City Qmm3d_71 of the City of Kalispell did meet and consider all expressions in W-M.1ting of said approval or disapproval of the proposed extension of the boundaries of said City of Kalispell; and WHEREAS, the City determined that the proposed annexation lisincluded within and conforms to the Kalispell City-tounty Master PaEan; and that the proper zoning for said property is Residenti2l h4artment, RA-2 in accordance with the City of Kalispell Zoning @rdJrr&nce an& the Kalispell City -County Master Plan;jand WHEREAS, the effective date of this annexation shoulif be the date thirty (30) days next succeeding the final passage of this ]Resolution and approval by the Mayor; and WHEREAS, the annexation is pursuant to Title 7, Cbaptem 2, Part 43, Annexation of Contiguous Land, Montana Co de Annotate&. NOW AND THEREFORE BE IT RESOLVED BY THE CITY COUNCIL, OF THE CITY OF KALISPELL AS FOLLOWS:' SECTION 1. That the real property as is more particalarly described in Exhibit "A", shall be annexed to the City. of Kalispell; and the boundaries of the City are hereby alltered to so provide. SECTION II. That the City Clerk -Treasurer of the City, of Kalisp6__1lis authorized and directed upon the effecLimc-date of this Resolution, which is thirty (30) � days next swexeding the passage of this Resolution and signature by the n-yor, to make and certify under the seal of the City of Lalii&pell a copy of the record of these proceedings as are ewtemd on the minutes of the Council and file said documents vtft the Flathead County Clerk and Recorder upon or after theeiEf-w.tive date hereof. SECTION III. From and af ter the date of the f i1bg zff se -id. documents in the office of the Flathe'ad County Cle:rlk and Recorder or the effective date of this Resolution,vb�i�v-er is later, said territory is part of the City of LaILE&W-11 and said territory and its citizens an . d property zhaln�,be subject to all debts, laws and ordinances and regifllarlom,­in force in the City of Kalispell and shall be entitled to the same privileges and benefits as are other parts of the C-ity., SECTION TV. All of said�realty so annexed to the City 0nall, be zonej--as Residential� '4partment, RA-2, in accordwyce with the City of 'Kalispell Zoning Ordinance and the Kalispel-1 City -County Master Pla nd the City zoning map shall be amended to so reflect. SECTION V. This Resolution shall be effective thirt-� (30) days from and after its final passage by the City Council and approval by the Mayor.
