A RESOLUTION To PROVIDE FOR THE ALTERATION OF THE BOUNIMTESz OF THE
CITY OF KALISPELL BY INCLUDING THEREIN AS AN ANNEXATIM A TRACT OF
LAND IN GOVERNMENT LOTS SEVEN (7) AND FOURTEEN (14), SE3=0N 6,
TOWNSHIP 28 NORTH, RANGE 21 WEST, P.M.M., FLATHEAD COUW-Y, MONTANA.,
AS IS MORE PARTICULARLY DESCRIBED IN EXHIBIT. "A", TO BE KN06N AS THE
IMMANUEL LUTHERAN HOME ADDITION NO. 196, TO ZONE SAID 7W.ERTY AS
RESIDENTIAL APARTMENT, RA-2, AND TO AMEND THE CITY ZCRTNG MAP
ACCORDINGLY.
WHEREAS, Spencer H. Ryder and Alice J. ;Ryder, the ems•. of a
tract of land described in Exhibit "A", requested on the: Tom_ day of
July, 1986, that the City Council of the City of KalisWII consider
the annexation of certain real property situated outside the baundarie3
of the City of Kalispell, but contiguous thereto, and
WHEREAS, the City Council on the. 2nd day of September, 119 ,passed
Resolution No. 3686, declaring an intention to annex m--ndn real
property, described above, to the City of :Kalispell; ana T rsuapl,
thereto the City Council did set a Public Hearing to bra— Ul ev h ova tlx-
annexation and due and proper notice of said Public Hearin.,Xas give
by the City Clerk -Treasurer; and
WHEREAS, the City Clerk -Treasurer received expression Jx.writing
of approval or disapproval of the proposed extension of the tkndaries
of the City of Kalispell from the freeholders of the territcayproposed
to be embraced therein; and
WHEREAS, on the 6th day of October, 1986, the City 3d_71 of the.
City of Kalispell did meet and consider all expressions in suing of
said approval or disapproval of the proposed extension of the boundaries
of said City of Kalispell; and
WHEREAS, the City determined that the proposed annexation iisincluded
within and conforms to the Kalispell City -:County Master Plan; and
that the proper zoning for said property is Residenti2l h4artment,
RA-2 in accordance with the City of Kalispell Zoning @rdJrr&nce an&
the Kalispell City -County Master Plan;..and
WHEREAS, the effective date of this annexation shoulif be the date
thirty (30) days next succeeding the final passage of this solution
and approval by the Mayor; and
WHEREAS, the annexation is pursuant to Title 7, Chaptem 2, Part
43, Annexation of Contiguous Land, Montana Code Annotate&.
NOW AND THEREFORE BE IT RESOLVED BY THE CITY COUNCIL, OF THE CITY
OF KALISPELL AS FOLLOWS:
SECTION I. That the real property as is more particalarly
described in Exhibit "A", shall be annexed to the Citjy. of
Kalispell; and the boundaries of the City are hereby alltered
to so provide.
SECTION II. That the City Clerk -Treasurer of the City, of
Ka ispell is authorized and directed upon the effee'Limc- date
of this Resolution, which is thirty (30) : days next sneering
the passage of this Resolution and signature by the n-yor,
to make and certify under the seal of the City of Lalii pelf
a copy of the record of these proceedings as are ewtem d on
the minutes of the Council and file said documents. `rim-; the
Flathead County Clerk and Recorder upon or after the emotive
date hereof.
SECTION III. From and after the date of the f i1bg zff seid
documents in the office of the Flathead County Cle:rlkand
Recorder or the effective date of this Resolution, �ev-er
is later, said territory is part of the City of �E&11
and said territory and its citizens and property shaln,be
subject to all debts, laws and ordinances and regifllati in

force in the City of Kalispell and shall be entity to the
same privileges and benefits as are other parts of the C-ity.

SECTION IV. All of said realty so annexed to the City 0nail
be zoned as Residential partment, RA-2, in accordce with
the City of 'Kalispell Zoning Ordinance and the Kaispel-1
City -County Master Plan and the City zoning map shall be
amended to so reflect.
SECTION V. This Resolution shall be effective thirty (30)
days from and after its final passage by the City Council
and approval by the Mayor..
