Resolution 3691 - Resolution of Intent - SID 337RESOLUTION NO. 3691 I A RESOLUTION OFi INTENTION TO CREATE SPECIAL IMPROVEMENT DIMICT NO- 337. BE 1T RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPEIL, MQNTANA: SECTION I. That it is the intention of the City Comc-il of the City of Kalispell, Montana, to create Special Improvement District No. 337 for the property described in Exhibit "A" attached hereto and by this reference made a part heyeaf- SECTION Ii. That the general character and nature of Tlte- propose pecial Improvement District is to totally fund, a sanitary sewer main with services to the property line beginniftig at Second Street East, south along College Avenue, Sy1wan Drive, Sylvan Court and Parkhill Court and to partiaTTy fu-n­d7 the cost of a lift station and sanitary sewer force maim to be located in Woodland Park, Kalispell, Flathead Coumty, Montana. SECTION III. That the District share the estimated cozr af said improvement which is One Hundred and Twenty-f ive 7hvuu�and Dollars ($125,000.00). SECTION IV. That it is the intention of the City Comc-U to charge the expenses of the work for improvements to lotz not fronting on the above named avenues and streets, as imelll as lots abutting the improvement because the lots not E=muing on improvement are benefited by the improvement amd the instal lation of a sewer � 1 ine - and f orce main in the armw.. is of more than local or ordinary benefit. SECTION V. That the entire cost and expense of said impmv4awnt shall be- assessed against all of the property withint the district as follows: A) Fifty per cent (50%) of�the District's portian of the cost of constructing and installing the sanitary sewer -.:-main, -lift station aiad force.ri�ain shall be assessed against each lot or parcel of land within said District for its proportion of half of the whole cost which its area bears to d6e area of the entire District. B) Fifty per cent (50%) of the District's cost of construction and installing the sanitary sewer, lift station and force main shall be assessed by. determining the lots fronting upon the improvement and assessing each lot as its frontage bears to its proportion of half of the whole cost of the improvement. Lots not fronting shall be assessed based upon an average fronting of those lots fronting the improvement. C ) The cost of constructing and installing service connections to the property line shall be assessed upon a lump sum based upon the bid price in the improvement district contract and assessed only against the lots, tracts and parcels of land served by the utility connections. SECTION VI. That said assessment shall be paid for knfull upon completion of the contract, or shall be paid in iftrty (30) equal semi-annual installments, extended over a Wiod of fifteen (15) years. Said assessments shall constitute a fund to be known as Special Improvement District Ao. 3371. SECTION VII. That said improvement shall be paid far. in Special Improvement District War -rants issued agaimt &aid District in sums not to exceed Five Thousand Dollars ($5,GM,00) each, bearing interest at a rate that is no greate-r than _e I allowed by the laws of the State of Montana from the date of registration until called for redemption or paid in full. SECTION VIII. That on�the 3rd day of November, 1986, at 7:30 P.M., in the City C�uncil Chambers of City Hall in the City of Kalispell,, Monta�a, at a regular meeting thereof-., the City Council will hea. and pass on any protests that may be made against the maki?9"Of said improvements or the creation of said District. SECTION IX. The City Clerk -Treasurer is hereby authorized and directed to. give proper notice of the passage of this Resolution by publication and mailing as required by law, such publication to be made in a daily newspaper published in the City of Kalispell, Montana. I SECTION X. Resolution No. 3569 and Resolution No. 3588 T—Resolution of Intention to Create S.I.D. #337 and Resolution Creating S.I.D. #337) are repealed by this Resolution No. 3691.
