Resolution 3689 - Call for Construction Bids - SID 337RESOLUTION NO. 3689 A RESOLUTION PROVIDING FOR THE CALL FOR CONSTRUCTION BIDS FOR SPECIAL IMPROVEMENT DISTRICT NO. 337. WHEREAS, the Mayor and City Council of the City of Kalispell, in compliance with the statutes of the State of Montana, did, on the 3rd day of June, 1985, create Special Improvement District No. 337 of the City of Kalispell for the purpose of totally funding co truction of a sanitary sewer main with services to the property linerte�inning at 9 Second Street East, South along College Avenue, Sy - Ivan Drive, Sylva32 Court and Park Hill Court and to partially fund the cos�.of a lift station and sanitary sewer force main to be located in Woodland Park, Kalispell, Flathead County, Montana, and in all of that area included in accordance with the terms and conditions as specified inResolutions No. 3569 and No. 3588; and WHEREAS, the City of Kalispell Director of Public Works has prepared plans and specifications for said construction. NOW THEREFORE, BE IT RESOLVED: SECTION 1. That the City Clerk -Treasurer forthwith call for bids for the construction in accordance with the laws of the State of Montana. SECTION 11. That the Notice of said Call for Bids be in substanti-a-I form of and contain the provisions of Exhibit "A" attached hereto. NO. 337 The City of Kalispell, Montana, will receive sealed bids for all labor, equipment and materials necessary for construction of the Woodland Park Area Sewer to meet or exceed the minimum specifications on file in the office of the Dixector of Public Works, City Hall, Kalispell, Montana. Bids will be.received by the City Clerk -Treasurer until 5:00 P.M. M.D.T., on the 6th day of October, 1986. All bids will be publicly opened and read aloud during a regular meeting of the City Council, commencing at 7:30 P.M. on the 6th day of October, 1986, in the Council Chambers, of City Hall, Kalispell, Montana. Proposals shall be addressed:- to' the City Clerk-Trea surer, Drawer 1997, Kalispell, Montana 59903-1997,1 and entitled WOODLAND PARK AREA SEWER. All bidders on the Woodland:Park Area Sewer shall possess an appropriate' Montana Contractor's, License, and the bidder's Montana Contractor',s License Number must appear on the bid envelope and the proposal submitted by the bidder. No contract shall be awarded to any bidder unless he is the holder of a license in the class within which the value of the project falls. The successful bidder will be assessed the Montana Contractor's withholding tax. All bids must expressly covenant that'if the bidder shall be awarded the contract the bidder will, within ten (10) days after award, enter .into a formal contract and give'good and sufficient bond to secure the performance of the terms and c6nditions of the contract; otherwise, the bidder shall pay unto the City of Kalispell the difference between the amount of ' the bid of the s * aid'bidder and.the amount for which the City of Kalispell legally contracts with another party to perform' said work if the latter amount is more than the former, but in no event shall bidder's liability or the surety of such bidder exceed the penal sum of 10%. All bidders shall, as bid security, accomp-any the bid with said sum in lawful money of the United States, or a cashiers check, certified check, bank money order or bank draft, in any case drawn and issued by a national banking association located in the State of Montana or a bid bond or bonds executed by a surety corporation authorized to do business in the State of Montana. Any such bank instrument or bond shall be payable directly to the City of Kalispell. If a contract is awarded, the bidder whose bid is accepted and who shall thereafter refuse to enter into and execute the proposed contract as stated in said covenant, shall absolutely forfeit such monies o� bank instruments to the City of Kalispell, and become immediately liable on said bid bond to said tum. The money, bank instrument or bid bond, as the case may be, shall be returned to those bidders whose bid is not accepted. No bid shall be withdrawn after the opening of bids without the consent of the City Council for a period of sixty (60) days after. the scheduled time of receiving bids. Any bidder wishing further information may obtain same from Ken Hammer, Public Works Director, City Hall, City of Kalispell, Montana. The City will accept the lowest responsible bid, but the Council reserves the right to reject any and all bids or to waive any t%chnicality or informality and accept any bid which may be deemed irt ehe best interest of the City of Kalispell. The successful bidder will be -required to abide by FedLral and State minimum wage and fringe benefit laws. The successful bidder will be, required to furnish an acceptable security for the full amount of the contract for faithful performance thereof and payment of labor, mate"rial and sub -contractor claims. Said project is 55% financed with Federal Funds. The successful bidder must comply with all requirements of applicable State and Federal Laws. NONDISCRIMINATION IN EMPLOYMENT. Bidders on this work will be required to comply with the President's Executive Orders Nos. 11246 as amended, 11458, 11518, and 11625. The requirements for bidders and contractors under these orders are explained in the Specifications. The following goals and timetables for minority and female utilization shall be included in all Federal and Federally assisted construction contracts and subcontracts in e'x-cess of $10,000. The goals are applicable to the contractors aggregate on -site construction work force, not merely that part of the work force that is performing the work on a Fede.r.al or Federally. assisted contract or subcontract, The appropriate goal will be inserte ' & in the �lank in Paragraph (d) of NOTICE OF REQUIREMENTS", contained in the Supplemental General Conditions. ENVIRONMENTAL PROTECTION AGENCY: Any contract or contracts awarded under this Advertisement for -Bids are expected to be funded in part by a grant from the United States Environmental Protection Agency. Neither the United States nor any of its departments, agencies or employees is or will be a part t ' o this Advertisement for Bids or any resulting contract. This procurement will be subject to regulations contained in 40 CFR 35.936, 35.938, and 35.939. MINORITY BUSINESS ENTERPRISE: Bidders on this work will be required to comply with Title 40 CFR 33.240 and Executive Order 12138. The requirements for bidders and contractors under this regulation which concerns utilization of Minority Business Enterprises (MBE) and Women's Business Enterprises (WBE) are explained in the Supplemental General Conditions.
