Resolution 3674 - Adopts Master Plan Amendment - 7th Ave ENRESOLUTION NO. 3674
A RESOLUTION ADOPTING A RECOMMENDED AMENDMENT TO THE KALISPELL CITY -
COUNTY MASTER PLAN.
WHEREAS, the City Council of the City of Kalispell on the 16th day
of September, 1985, adopted the Kalispell City -County Master Plan,
and
WHEREAS, Reinhold Lindner applied for an amendment to the Kalispell
City -County Master Plan to change the land use designation of a
certain parcel of land in the city limits of Kalispell on the 10th
day of April, 1986, and
WHEREAS, the request is to amend the map of said plan to change
the land use designation from Light Industrial to High Density Urban
Residential for 3.8 acres of land near the southerly terminus of
Seventh Avenue East North, which is more particularly described in
the attached Exhibit "A", and
WHEREAS, the Flathead Regional Development Office has evaluated
the request and submitted a report to the Kalispell City -County Planning
Board and Zoning Commission with findings and recommendations related
thereto, and
WHEREAS, a Public Hearing was duly noticed and held on the 13th
day of May, 1986, by the Kalispell City -County Planning Board and
Zoning Commission in accordance with Section 76-1-603, M.C.A., and
WHEREAS, said Board carefully reviewed the application, staff report,
and planning testimony pertaining to said application and made the
following findings:
That the subject property exhibits exceptional opportunities
for views of Woodland Park and the mountain range to the
east;
That development of the property can affect the quality of
views from Woodland Park and that residential use of the
property may be more ",view" compatible as compared to industrial
use;
That it is possible to effectively screen residential develop-
ment of the property from the adjoining commercial and
industrial uses;
That all necessary utilities are available to provide services
to the property;
That concerns for personal safety can be adequately addressed
via subsequent approval processes; and,
That a change in land use designation from Light Industrial
to High Density_ Residential will be in the general public
interest and be in substantial conformance with the goals
and intent of the Kalispell City -County Master Plan; and
WHEREAS, the Kalispell City -County Planning Board and Zoning
Commission recommended to the City Council of the City of Kalispell
and to the Board of County Commissioners of Flathead County that the
Kalispell City -County Master Plan as found in Chapter One of the Plan
be amended to change the land use designation for the subject property
from Light Industrial to High Density Urban Residential, and
WHEREAS, the City Council did pass RESOLUTION NO. 3669 on the 16th
day of June, 1986, declaring an intention to adopt, revise or reject
the recommended amendments to the Kalispell City -County Master Plan,
in accordance with Section 76-1-604, M.C.A.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Kalispell, as follows:

SECTION I. That the Kalispell City -County Master Plan Map
as found in Chapter One of said Plan is hereby .amended by
changing the land use designation of the parcel of land
described in Exhibit "A" from Light Industrial to High Density
Urban Residential.
SECTION II. This Resolution shall become effective thirty
0) days from and after its final passage by the City
Council and approval by the Mayor.
