A RESOLUTION CONDITIONALLY APPROVING THE PRELIMINARY PLAT OF ROYAL
PINES SUBDIVISION.
WHEREAS, Charles E. Remick and Beverlee J. Remick on the 7th day
of May, 1986, made an application to subdivide a tract of land
located in Kalispell, Montana, more particularly described in Exhibit
"A", attached hereto and for purposes of this Resolution made a part
hereof, and
WHEREAS, the Kalispell City -County Planning Board and Zoning
Commission, and the Flathead Regional Development Office reviewed
said application and submitted a report on the proposed subdivision
to the City Council on the 16th day of June, 1986, and
WHEREAS, the City Council of the City of Kalispell reviewed the
application, and the report made by the Kalispell City -County Planning
Board and Zoning Commission and the Flathead Regional Development
Office, and considered public input, and
WHEREAS, the City Council, after reviewing the preliminary plat,
determined that conditional approval of the preliminary plat is in
the public interest, and have made such determination based upon the
following criteria: .
A) Basis of need for subdivision
B) Expressed public opinion
C) Effects on agriculture
D) Effects on local services
E) Effects on taxation
F)
Effects
on natural
environment
G)
Effects
on wildlife
and wildlife habitat
H) Effects on public'health and saf6ty.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Kalispell, Montana as follows:
SECTION I. Preliminary Plat of Royal Pines Subdivision is
hereby approved and the same shall be known as "Royal Pines
Addition No. 199 ", Kalispell, Montana, subject to the
following conditions:
1. That all improvement drawings, including plans for
water and sewer extension and connection, hydrants, and for
construction of the cul-de-sac and disposal of drainage be
approved by the City of Kalispell prior to final plat approval.
2. That the number of lots be reduced to meet all the
applicable dimensional and other standards applicable to an
RA-1 Zone.
3. That a temporary cut -de -sac be built, in accordance
to plans approved by the Director of Public Works, near the
westerly terminus of the proposed 17th Street West, with an
improved radius of 45 feet'. The cul-de-sac to be constructed
may occupy the right-of-way 17th Street West as well as the
developer's property, but must not be located so as to interfere
with the use of Tract 8Y, Section 18, T28N, R21W.
4. That 17th Street West be dedicated as a public road
with a minimum right-of-way width of 40 feet and that all
necessary surveying and associated costs of such dedication
be borne by the subdivider.
5. That all required improvements pertaining to roadway
or utilities be designed and built at developer's expense
and in accordance with the City's standards for design and
construction.
6. That the property be annexed into the City of Kalispell
and be zoned Residential RA-1.
7. That a fee be paid in lieu of parkland dedication.
Such fee shall be determined by multiplying the market value
of the land, $44,000.00/acre, by the net lot acreage of the
subdivision. Based upon the preliminary plat, the corres-
ponding fee -in -lieu is $4,840.00.
8. That the subdivider submit a storm drainage analysis
and plan for review and approval by the City Director of
Public Works as required pursuant to Section 3.11B of the
Kalispell Subdivision Regulations.
9. That all required improvements be completed prior to
the final plat approval or be properly guaranteed in accordance
with Chapter 5 of the Kalispell Subdivision Regulations.
10. That all parties having a financial or legal interest
in the property consent to this subdivision.
11. That the Developer execute a document holding harmless
the City from suit as the same might arise as a result of
future operation of the City's asphalt plant on property
adjacent to Royal Pines Addition No. 199.
SECTION II. That upon proper review and filing of the final
plat of said subdivision in the office of the Flathead County
Clerk & Recorder, said premises shall be a subdivision of
the City of Kalispell.

A tract of land in the SEISE ofof Section 18, Township 28 North, Range
21 West, M.P.M., Flathead County, Montana, described as follows:
Beginning at a point 333 feet West and 250 feet North of the
Southeast corner of the SEISE! of said Section 18, said 333
feet West being on the South boundary line of said SE4SE4,
thence
North a distance of 125 feet to a point; thence
West a distance of 3501 feet to a point; thence
South a distance of 125 feet to a point; thence
East a distance of 3502 feet to the place of beginning.
