Resolution 3666 - Resolution of Intent - Annexation - Royal Pines AdditionRESOLUTION NO. 3666 A RESOLUTION TO CONSIDER THE ANNEXATION OF THE TERRITORY TO THE CITY OF KALISPELL LOCATED IN THE SE"SE1; OF SECTION 18, TOWNSHIP 28 NORTH, RANGE 21 WEST, M.P.M., FLATHEAD COUNTY, MONTANA, AS IS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A", TO BE DESIGNATED AS THE ROYAL PINES ADDITION NO. 199, TO FIX A DATE OF PUBLIC HEARING THEREON; AND TO PROVIDE FOR THE PUBLICATION OF NOTICE OF SAID HEARING. WHEREAS, Charles E. and Beverlee J. Remick, the owners of t-he tract of land described in Exhibit "A", has requested tie City Council Of- the Cicy of Kalispell to pass a resolution of Intention to consider the annexation of the tract of land described in Exhibit "A" to the City of Kalispell, and WHEREAS, it appears to the City of Kalispell that the owners of said tracts of land are desirous of being included within the boundaries of the City of Kalispell, and WHEREAS, the City Council of the City of Kalispell has the authority under Section 7-2-4311, M.C.A., to extend the corporate limits of the City of Kalispell under the procedures set forth in Title 7, Chapter 2, Part 43, M.C.A.., and WHEREAS, the City of Kalispell is desirous of annexing the within described property and that it is in the best interests of the City of Kalispell that said tract be considered for annexation by the City Council of the City of Kalispell. NOW AND THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION I. It is the intention of the City of Kalispell that certain real property located in the SEISE4 of Section 18, Township 28 North, Range 21 West, M.P.M. , Flathead County, Montana, to be designated as the Royal Pines Addition No. 199, shall be considered for annexation to the City of Kalispell. Said territory is more particularly described in Exhibit "A" attached hereto and for purposes of this Resolution made a part hereof. . SECTION II. A public hearing on said -proposed annexation will be held by tine City Council at its regularly scheduled meeting held in the Council Chambers, City Hall, commencing at 7:30 P.M. on the 2nd day of September , 1986. SECTION III. That the City Clerk -Treasurer shall forthwith prepare notices (1) to be mailed to all owners and purchasers under.Contracts for Deed of the property in the territory to be embraced, and (2) to publish in the Daily Inter Lake, a daily newspaper published at Kalispell, Montana, proper notice of said Public Hearing. John "Ed' -Kennedy 3f., Mayor ATTEST: City Clerk -Treasurer EXHIBIT A A tract of land in the Southeast 1/4 of the Southeast 1/4 of Section 18, Township 28.North, Range 21 West, Principal Meridian Montana, Flathead County, Montana and more particularly described as follows: Commencing at the Southeast corner of Section 18, Township 28 North, Range 21 West, P.M.M., thence West, a distance of 333 feet; thence North, a distance of 250 feet to the Point -of -Beginning; thence North, a distance of 125 feet; thence West, a distance of 350-1/2 feet to a point which is the Southwest corner of a tract described on Warranty Deed in Book 518 Page 730, Records of Flathead County, Montana; thence South, a distance of 125 feet; thence East, a distance of 350-1/2 feet to the Point -of -Beginning. Said tract contains 1.006 acres, more or less, subject to and together with all easements of record.
