A RESOLUTION TO ABANDON A PORTION OF AN ALLEY BETWEEN MAIN STREET AND
FIRST AVENUE WEST AND WEST CENTER STREET TO FIRST STREET WEST, AS
MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" ATTACHED HERETO AND INCOR-
PORATED HEREIN BY REFERENCE.
WHEREAS, on the 9th day of May, 1986, the City of Kalispell received
a petition from First Interstate Bank of Kalispell, N.A, William D.
Shiell and Patsy J. Shie7_l, Gordon T. Pirrie and Carol Pirrie, and
the Fraternal Order of Eagles, No. 234, the owners of record of all
the lots and parcels along an alley located between Main Street and
First Avenue West and West Center Street to First Street West, requesting
that the City of Kalispell vacate said alley pursuant to Section
7-14-4114, M.C.A., and
WHEREAS, notice of said peition was published in the Daily Inter
Lake, a daily newspaper, published in Kalispell, Montana on the 12th
day of May, 1986, and
WHEREAS, on the 19th day of May, 1986, the City Council of the
City of Kalispell held a public hearing to hear proponents and opponents
on the closure and to further determine any action, that would serve
the public interest, and
WHEREAS, it was determined that the petition hereinbefore mentioned
was properly presented to the Council, and
WHEREAS, it was determined at said public hearing that the closure
of a portion of the alley between Main Street and First Avenue West
and West Center Street to First Street West would be in the public
interest.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, MONTANA, THAT:
SECTION I. That a portion of the alley between Main Street
and First Avenue West and West Center Street to First Street
West, as is more particularly described in Exhibit "A" attached
hereto and by reference incorporated herein, is hereby vacated
as the same is no longer required for public use and the
public interest will be served by its vacation.
SECTION II. This Resolution shall. take effect and be in
force from and after thirty (30) days of its passage and
signed by the Mayor.
PASSED AND APPROVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF
KALISPELL, THIS 19th DAY OF MAY, 1986.
