Resolution 3621 - Amends Reso 3500 - Buffalo Head TownhousesRESOLUTION NO. 3621 A RESOLUTION AMENDING RESOLUTION NO. 3500 BY CLARIFYING THE APPROVAL OF BUFFALO HEAD TOWNHOUSES, A RESUBDIVISION OF BUFFALO HEAD ADDITION NO. 92. WHEREAS, the Buffalo Head Townhouses, a Resubdivision of Buffalo Head Addition No. 92 was approved as a subdivision of the City of Kalispell by Resolution No. 3500 on the 7th day of November, 1983, and WHEREAS, since the passage of said Resolution four townhouses, totaling 16 living units, have been constructed on property within the subdivision, and WHEREAS, the developers of the property have, due to design consideration, encroached on areas within the subdivision dedicated to the Buffalo Head Homeowner's Association as "common area", and WHEREAS, because of such encroachments it has been necessary to re-evaluate the conditions of subdivision approval granted in Resolution No. 3500. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION 1: That the construction of any building or structure in the "common area" as described in the Final Plat of Buffalo Head Addition #92 shall be prohibited. SECTION 11. That in those instances where design consideration make observance of Section I and the 15' front set back requirements of RA-1 Zoning impractical, structures may be allowed within the subdivision which extend beyond the front sub lot line provided that the developer provide adequate off-street parking and under no circumstances shall the building fronting on Ponderosa be less than 15' from the edge of the roadway. SECTION Ill. That no front set back shall be required for lots fronting on the Private Drives. SECTION IV. The effect of the Resolution amending Resolution No. 3500 shall terminate with expiration of Resolution No. 3500 on the 30th day of November, 1986. SECTION V. This Resolution shall apply exclusively to Buffalo Head Townhouses, and shall not be considered as precedent for other subdivision heretofore reviewed or to be reviewed by the City Council of the City of Kalispell.
