A RESOLUTION CONDITIONALLY APPROVING THE PRELIMINARY PLAT OF
KALISPELL ADDITION NO. 174.
WHEREAS, Lorna Schwartz, the owner of a tract of land, to -wit; Kalispell
Addition 174, Kalispell, Flathead County, Montana, more particularly .described in
Exhibit "A", on the 20th day of May, 1985, made an application to subdivide said
property, and
WHEREAS, the Flathead Regional Development Office reviewed 'said Application
and submitted a report on the proposed subdivision on the 18th day of June, 1985
and
WHEREAS, the proposed subdivision is a minor subdivision under the provisions
of §76-3-505, M.C.A., and is entitled to summary review under §2.7 of the City of
Kalispell, Subdivision Regulations, and
WHEREAS, the owner by and through Doyle Enterprises, Inc., presented the
Preliminary Plat of said subdivision for review by the City Council at the regularly
scheduled council meeting held on the 15th day of July, 1§85, and
WHEREAS, the City Council of t-he City of Kalispell, have reviewed the Preliminary
Plat, and made the following findings based upon the public interest criteria contained
in Montana law:
1) EFFECTS ON PUBLIC HEALTH AND SAFETY:
No increased "threat" to public health and safety will result with
development of the subdivision. The proposed subdivision will be provided
with City services including fire and police protection and it "fits" the
general character of the area.
2) EFFECTS ON WILDLIFE AND WILDLIFE HABITAT:
The subject property offers only marginal habitat to wildlife and the
surrounding urban uses preclude any substantial use of the property
by wildlife.
3) EFFECTS ON THE NATURAL ENVIRONMENT:
Surface and ground water should not be significantly impacted by
the subdivision nor should extensive grading be necessary with develop-
ment of the property. Similarly, no plant communities of any particular
importance will be lost.
4) EFFECTS ON TAXATION:
Assuming that each of the lots will have a market value of $18,000.
the annual taxes (exclusive of any special assessments) will be approxi-
mately $277 per lot. Taxes will increase substantially when homes are
built on the property.
5) EFFECTS ON LOCAL SERVICES:
A. Schools:
Up to four single family homes may be built with approval of the
subdivision. Up to six children may be associated with the four houses
but this number of children should not adversely impact the school
system.
B. Parks and Recreation:
The net affect of approving this subdivision will be the creation of
one additional lot, from three lots to four lots. Park land dedication is
not required as per Montana Statutes when only one additional lot is
being created.
C. Fire Protection:
The City of Kalispell Fire Department expressed no concerns about
the proposed subdivision. Sufficient fire hydrants are located nearby
(within 100 feet) to handle: -most fire emergencies that may be' associated
with the subdivision.
D. Police Protection: 4
The City of Kalispell Police Department expressed no concerns about
the proposed subdivision:
E. Medical: T.
The subdivision is within one mile of Kalispell Regional Hospital and
other related medical facilities. The additional residents that may be.
associated with the subdivision can be easily accommodated by these
existing facilities.
F. Roads:
City streets front the property. Access to individual homes will be
by private driveway. The city streets have sufficient capacity to handle
the vehicle "trips" from the four lots. Curbs and gutters on the
streets adjoining the subdivision will be built in accordance with a condi-
tion imposed when the property was annexed into the city.
G . Water/Sewer:
Adequate city sewer and water lines are available to the property.
Again, extension of these lines to the individual homes will be the
responsibility of the owner as per a condition of annexation.
6) EFFECTS ON AGRICULTURE:
Approval of this subdivision will not impact agriculture in any manner.
7) EXPRESSED PUBLIC OPINION:
The subdivision is being processed by the summary review procedure
which, in this case, does not require public notification or hearing.
8) NEED FOR SUBDIVISION:
The proposed subdivision is located in a "desirable" residential location
where demand for housing appears to be high. Approval of the subd_tv.ision
should also facilitate the "infill" of existing residential neighborhoods.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL AS FOLLOWS:
SECTION I. The Preliminary Plat of the Kalispell Addition No. 174 is
hereby approved, as serving the public interest, and the name shall be
known as the Kalispell Addition No. 174 subject to the following conditions:
1. That the subject property be annexed into the City of
Kalispell and that the improvements required pursuant to
the annexation approval be built prior to approval of the
final plat.
2. That a public utility easement be shown on the face of
the plat for the existing electric, telephone, and cable TV
lines that pass to the rear of the lots.
3. That a surface water drainage be disposed in a manner
acceptable to the City of Kalispell Director of Public Works.
SECTION ll. That the classification of said premises under the Kalispell
Zoning Ordinance shall not change by this action.
SECTION Ill. That park dedication shall not be required because the
property is subject to the exception contained in Section 76-3-606(3)
MCA.
SECTION IV. That upon proper review and filing of the final plat of
said subdivision in the Office of the Flathead County Clerk and Recorder,
said premises shall be a subdivision of the City of Kalispell.
