Resolution 3591 - Resolution of Intent - Annexation - Park View Terrace Lift StationRESOLUTION NO. 3591 A RESOLUTION OF INTENTION TO ANNEX TERRITORY TO THE CITY OF KALISPELL, TO BE KNOWN AS PARKVIEW TERRACE LIFT STATION NO. 185, TO RECOMMEND ZONING SAID PROPERTY AS P-1 AND TO FIX A DATE OF PUBLIC HEARING THEREON AND TO PROVIDE FOR THE CITY CLERK -TREASURER TO RECEIVE EXPRESSIONS OF APPROVAL OR DISAPPROVAL IN WRITING THERETO AND TO PROVIDE FOR THE PUBLICATION OF NOTICE OF THIS RESOLUTION. WHEREAS, in the judgement of the City Council of the City of Kalispell, Montana, it is in the best interest of the City of Kalispell and the inhabitants thereof, that the contiguous platted tracts encompassed in Exhibit "A" attached hereto and for purposes of this Resolution made a part hereof, be annexed to the City of Kalispell, so that the boundaries of the .City of Kalispell would be extended so as to include the same within the corporate limits of the City of Kalispell, to zone said property as Residential, R-4; and WHEREAS, the City of Kalispell desires to annex the property to the City Limits under the provisions of Title 7, Chapter 2, Part 43, M.C.A. (Annexation of Con- tiguous Land). NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION I. That it is the intention of the City of Kalispell that certain territory comprising the "Parkview Terrace Lift Station No. 1851" be embraced within the corporate limits of the City of Kalispell and the boundaries of said City be so extended so as to include the same. Said territory is more particularly described in Exhibit "A'" attached hereto and made a part hereof. SECTION II. That it is further the intention of the City of Kalispell that property described in Exhibit "A"" be zoned as Residential, R-4 upon annexation. SECTION III. The City Clerk --Treasurer shall forthwith prepare and publish in the Daily Inter Lake, a daily newspaper published at Kalispell, Montana, proper notice of this Resolution of intention at least' once- a week for two successive weeks next proceeding the regularly scheduled Council meeting at which said Annexation will be considered. SECTION IV. For a period of twenty days after the first publication of said notice by the City Clerk -Treasurer, said City Clerk -Treasurer will receive expressions in writing of approval or disapproval of the proposed extensions of the boundaries of said City of Kalispell from freeholders of territory proposed to be embraced therein. SECTION V. At the regularly scheduled meeting of the City Council of the City of Kalispell next succeeding the expiration of said twenty days, the City Clerk -Treasurer shall lay before the City Council all com- munications in writing so received by him for the City Council's considera- tion. ATTEST: Don Halver, City Clerk -Treasurer EXHIBIT "A" A tract of land situated in Government Lot One (1 ) of Section One (1 ), Township 28 North, Range 22 West, P.M.M., Flathead County, Montana, and more particularly described as follows: Commencing at the Northeast corner of said Government Lot One (1); thence South 1139' West and along the Easterly boundary line of said Lot 1 , a distance of 40.0 feet to a point on the Southerly boundary line of a County Road to the true point of beginning of the tract of land being described; thence North 89045' West, and along the Southerly boundary line of said County Road and parallel to the Northerly boundary line of said Lot 1, a distance of 50.0 feet to a point; thence South 1139' West, and parallel to the Easterly boundary line of said Government Lot 1, a distance of 100.0 feet to a point; thence South 89045' East, and parallel to the Northerly boundary line of Government Lot 1 , a distance of 50.0 feet to a point on the Easterly boundary line of said Government Lot 1 ; thence North 1039' East and along the Easterly boundary line of said Govern- ment Lot 1 , a distance of 100.0 feet to the point of beginning.
