Resolution 3588 - Creating SID 337RESOLUTION NO. 3588 A RESOLUTION CREATING SPECIAL IMPROVEMENT DISTRICT NO. 337 FOR THE PURPOSE OF TOTALLY FUNDING A SANITARY SEWER MAIN WITH SERVICES TO PROPERTY LINE BEGINNING AT SECOND STREET EAST, SOUTH ALONG COLLEGE AVENUE, SYLVAN DRIVE, SYLVAN COURT AND PARK HILL COURT AND TO PARTIALLY FUND THE COST OF A LIFT STATION AND SANITARY SEWER FORCE MAIN TO BE LOCATED IN WOODLAND PARK, IN THAT CERTAIN AREA DESCRIBED IN EXHIBIT "A". BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA: WHEREAS, on ' the 18th day of March, 1985, said Council did pass and adopt Resolution No. 3569, entitled a Resolution of Intention to Create Special Improvement District No. 337; and WHEREAS, the City Clerk -Treasurer of said City did give Notice of the passage of said Resolution by publishing same for five successive days in the Daily Inter Lake, a daily newspaper published in Kalispell, Montana, beginning on April 18, 1985, and also on April 18, 1985, true copies of said Notice were. mailed to all persons having real property in said district; and WHEREAS, on the 6th day of May, 1985, at the next regular meeting of said Council, the Council did conduct a hearing on said Resolution No. 3569, and no protests, written or oral, were made or presented against the creation of Special Improvement District #337, or there were not sufficient protests filed with the Clerk -Treasurer to prevent further proceedings therein; and NOW THEREFORE, said Council does hereby create Special Improvement District #337 to totally fund a sanitary sewer main with services to property line beginning at Second Street East, south along College Avenue, Sylvan Drive, Sylvan Court and Park !-fill Court land to partially fund the cost of a lift station and sanitary sewer force main to be located in Woodland Park, in that certain area described in Exhibit "A". The approximate cost of said improvements is estimated to be One Hundred Twenty-five Thousand Dollars ($125,000.) . The cost of said improvements shall be assessed against all of the property within the district as follows - a). Fifty percent (50%) of the District's portion of the cost of constructing and installing the sanitary. sewer main, lift station and force main shall be assessed against each lot or parcel of land within said district for its. proportion of half of the whole cost which its area bears to the area of the entire district. b) Fifty percent (50%) of the District's cost of constructing and installing the sanitary sewer, lift stations and force main shall be assessed by determining the lots fronting upon the improvement and assessing each lot as its frontage bears to half of the whole cost of the improvement. Lots not fronting shall be assessed based upon an average fronting of those -,lots fronting the improvement. c) ' The cost of constructing and installing service connections to the property lines shall be assessed upon a lump sum based upon the bid price in the improvement district contract and assessed only against the lots, tracts and parcels of land served by the utility connections. The cost of said improvements may be paid in full upon completion of the contract or in forty equal semi-annual installments extending over a period of twenty years.
