Resolution 3583 - Abandon 9th Street West btwn Main and 1st Ave WestRESOLUTION NO. 3583 A RESOLUTION TO ABANDON NINTH STREET WEST BETWEEN MAIN STREET (HIGHWAY #93) AND FIRST AVENUE WEST. WHEREAS, on the 22nd day of March, 1985, the City of Kalispell received a petition from Flathead County, James H. Calbick and Jeanette S. Calbick owners of record of all lots along Ninth Street West between Main Street (Highway #93) and First Avenue West, requesting that the City of Kalispell vacate said street pursuant to Section No. 7- ' 14-4114, M.C.A., and ly WHEREAS, notice of said petition was published in the Daily Inter Lake, a dai newspaper, published in Kalispell, Montana, on the 30th day of April, 1985, and WHEREAS, on the 6th day of May, 1985, the City Council of the City of Kalispell held a public hearing to hear proponents and opponents on the closure and to further determine any action, that would serve the public interest, and WHEREAS, it was determined that the petition hereinbefore mentioned was properly presented to the Council, and WHEREAS, it was determined at said public hearing that the closure of Ninth Street West between Main Street (Highway #93) and First Avenue West would be in the public interest. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA, THAT: SECTION 1. All that part of the City street commonly known as Ninth Street West, between Main Street (Highway #93) and First Avenue West, is hereby vacated as the same is no longer required for public use and the public interest will be served by its vacation. SECTION 11. This Resolution shall take effect and be in force from and after thirty (30) days of its passage and signed by the Mayor.
