A RESOLUTION OF INTENTION TO ABANDON NINTH STREET WEST, BETWEEN
MAIN STREET (HIGHWAY #93) AND FIRST AVENUE WEST.
WHEREAS, on the 22nd day of March, 1985, the City of Kalispell received a
petition from James H. Calb.ick, Jeanette S. Calbick, and the Flathead County
Commissioners, (Kenneth H. Krueger and Allen Jacobson), the owners of all the
lots along Ninth Street West between Main Street (Highway 993) and First Avenue
West,, requesting that the City of Kalispell vacate said Street, pursuant to Section
7-14-4114, M.C.A., and
WHEREAS, the vacation of said Street would facilitate the pending construction
of the Flathead County Justice Center, and
WHEREAS, the City Council is desirous of obtaining public comment on the
Petition and determining whether or not said Street should be abandoned only after
public notice and in the public's best interest.
NOW THEREFORE, IT 1S RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL AS FOLLOWS:
SECTION I: That the City Council shall on the 6th day of May, 1985
hold a public hearing on and consider the closure and vacation of:
1) Ninth Street West between Main Street and First Avenue
West.
SECTION II. That the City Attorney and City Clerk -Treasurer are
hereby directed to schedule said public hearing for the Council and to
give due and proper notice of said publishing as required by Section
7-14-4114, M.C.A.
