Resolution 3575 - Preliminary Plat - Colonial Villa�3 RESOLUTION NO. 3575 A RESOLUTION CONDITIONALLY APPROVING THE PRELIMINARY PLAT OF COLONIAL VILLA. WHEREAS, Tom Lydon, Managing Partner, on beh . alf of LSR Partnership, a Partnership, on the 28th day of February, 1985, made an application to subdivide a tract of land located in Kalispell, Montana, more particularly described in Exhibit "A", attached hereto and for purposes of this Resolution made a part hereof, and WHEREAS, the Kalispell Ci ty County Planning Board and the Flathead Regional Development Office reviewed said Application and submitted a report on the proposed subdivision to the City Council on the 15th day of March, 1985, and WHEREAS, the City Council of the City of Kalispell, after due and proper notice, held a public hearing on said proposed subdivision on the 15th day of April, 1985, and at said public hearing reviewed the City -County Planning Board report and recommendations and considered all public input, and WHEREAS, the City Council, after reviewing the Preliminary Plat, dete : rmined that conditional approval of the Preliminary Plat is in the public interest, and have made such a determination based upon the following criteria - a) basis of need for the subdivision b) express public opinion c) effects on agriculture d) effects on local services e) effects on taxation f) effects on natural environment g) effects on wild life and wild life habitat h) effects on public health and.safety , NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Kalispell, Montana SECTION 1. The Preliminary Plat of Colonial Villa is hereby approved and the same shall be known as "Colonial Villa", Kalispell, Montana, subject to the following conditions: 1. That all common. areus outside the.�-building, roadway and parking areas be suitably landscaped' including a border of trees along East Washington Street in accordance with an approved landscaping plan. 2. That all sediment and run-off created during grading actitivites be contained on -site using acceptable erosion control practices. 3. That the internal street system of the subdivision be designed for 24 foot wide roadways or as otherwise acceptable to the Kalispell Fire Department. 4. That all vehicular ingress/egress be restricted to East Washington Street. 5. That the developer pave, at his expense, East Washington Street beginning at the intersection of Eighth Avenue East North and East Washington Street, easterly to a point ten feet beyond the easterly limits of the access road to the Colonial Villa site. The roadway shall be thirty (30) feet in width and shall adhere to all requirements of Kalispell's Standards and General Provisions for Design and Construction. Such roadway shall also be terminated with a cul-de-sac having at least a 24 foot radius. 6. That the drainage improvements be installed as submitted except as otherwise amended by the City. 7. That all improvements including connection to the City water and sewer systems be installed pursuant to City Standards at developer's expense. 8. That the location of central garbage storage areas be acceptable to the City garbage service. 9. That cash in the amount of $525., or an amount otherwise determined to be appropriate by the City Council, be accepted in lieu of park dedication. 10. That all the roads and other improvements in the sub- division be privately owned and maintained. 11. That "Consent to Plat" forms be completed by all indi- viduals having a legal interest in the property to be platted. 12. That no unit be occupied until such time as all the improvements shown on the preliminary plat and accompanying engineering drawings, or as required herein, are complete. 13. That the subdivision location be annexed to the City of Kalispell. 14. That a fire hydrant be installed according to City Standards and be operable prior to commencement of con- struction. SECTION 11. That the classification of said premises under the Kalispell Zoning Ordinance shall not change by the action. SECTION III.. That the park dedication required by Section 76-3-606 M.C.A. shall be satisfied by the observance of Section 1, (9), supra. SECTION IV. That upon proper review and filing of the final plat of said subdivision in the Office of the Flathead County Clerk & Recorder, said premises shall be.a subdivision of the City of Kalispell.
