A RESOLi'TION TO APPROVE THE PRELPIINAR�' PLAT OF T14E RESUBC ivis OF A PORTION OF LOT 1, BLOCK 1 LE=% 1S ArvD CLARK SECOND ADDITION ADDITION - ADDITION NO. 769, CITY OF KALISPELL, MONTANA. WHEREAS, Doyle Enterprises, on behalf of Ronald E. Pack, the owner of Lot 1, Block 1. Lewis and Clark Second Addition, City of Kalispell, Montana, has petitioned for the approval of the resubdivision of said premises to be known as the Resubdivision of a Portion of Lot 1 , Block 1 of Lewis and Clark Second Addition - Addition No. 169 to Kalispell, and all persons having an interest in said premises have in writing consented to the resubdivision of said premises, as required by Sectiori 76-3-613, M.C.A. , and WHEREAS, said resubdivision does qualify for summary review under the City of Kalispell Subdivision regulations, and WHEREAS, The Flathead Regional Development Office has reviewed and recom- mended City approval of said resubdivision, and WHEREAS, the City Council, in considering this request has found, from the preliminary plat and evidence relating thereto, that said resubdivision is in the public interest, and in making said finding,. the Council has considered and weighed (a) the basis for the need for the plat amendment; (b) expressed public opinion; (c) effects on agriculture; (d) effects on local services; (e) effects on taxation; (f) effects on wildlife habitat, and (g) effects on the public health and safety. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA, SECTION 1. The petition of Doyle Enterprises on behalf. -of Ronald E. Pack, for approval of the Resubdivision of a Portion of Lot) , Block 1 of Lewis and Clark Second Addition - Addition No. 169 to Kalispell, Montana is hereby approved subject to the following condition: 1. All requirements of. the City of Kalispell and the Depart- ment of Health and Environmental Sciences regarding water, sewer, fire flow, drainage, and other improvements be met and be approved by the -respective City Departments. 2. A fire hydrant which meets the City of Kalispell Public Works and Fire Protection Standards be located near the northwest corner of the proposed site, to be paid for by developer at time of construction. 3. All required improvements be' completed prior to the approval of the final plat or the developer shall enter into a written subdivision improvements agreement with the City guaranteeing the construction and installation of all improve- ments. 4. All delinquent taxes, if any, be paid prior to approval of the final plat. SECTION 11. The classification of said premises under the Kalispell Zoning Or -Ordinance shall not be changed by this action. SECTION 111. That no portion of said premises need be dedicated to the City for park purposes, and is exempt in accord with Section 76-3-606 (3), M.C.A.
