Resolution 3558 - Adopts Amendments to Kalispell Land Use Plan137 3 . RESOLUTION NO. 3558 A RESOLUTION TO ADOPT, RECONU0E,NDED ANIEND,MENTS TO THE KALISPELL LAND USE PLAN. WHEREAS, the City Council of the City of Kalispell, Montana, did on the 21st day of October, 1974, adopt the Comprehensive Plan for the Kalispell Planning Area (Kalispell Land Use Plan), and WHEREAS, a group of 23 property owners, on the 5th day of June, 1984, submitted a Petition for a proposed amendment of the Kalispell Land Use Plan, currently in effect for an area bounded by West Evergreen School, Calvary Lutheran Church, Willow Drive and Risen Christ Catholic Church, situated in the Kalispell City -County Planning Area, and WHEREAS, the Flathead Regional Development Office reviewed and evaluated the Kalispell Land Use Plan within the subject area in terms of environmental impact, site potentiality and availablility of services; and thereafter did draft its report and recommendations and direct said report and recommendations to the Kalispell City -County Planning Board, and WHEREAS, the Kalispell City -County Planning Board, on the 10th day of July, 1984, at 7:30 P.M. in the Council Chambers of the City Hall, Kalispell, Montana, held a public hearing, after due and proper notice, and received public comment upon the report and recommendations of the Flathead Regional Development Office, and WHEREAS, after consideration of the report, recommendations and suggestions elicited at said public hearing, the Kalispell City -County Planning Board by Reso- lution (#KPA-84-02), pursuant to Section 76-1-603, M.C.A., recommended to the City Council of the City of Kalispell, Montana, and the Board of County Commis- sioners of Flathead County, Montana, that the Kalispell Land Use'Plan be amended, and WHEREAS, the City Council of the City of Kalispell considered itadvisable that they consider the recommendation of the Kalispell City -County Planning Board and adopt a Resolution of Intent to Adopt Recommended Amendment to the Kalispell Land Use Plan, and WHEREAS, on the 9th day-- of ;'October, 1984 � the :Flathead Board of Gbunty Commissioners passed Resolution No. 527A, adopting the recommended amendment of the City County Planning Board, and fr WHEREAS, on the 3rd day of December, 1984, the City Council met and considered Resolution No. 3550 "A RESOLUTION OF INTENTION TO ADOPT, REVISE, OR REJECT RECOMMENDED AMENDMENTS TO THE KALISPELL LAND USE PLAN." NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL: SECTION 1. That the City Council of the City of Kalispell adopts the recommended amendments to the Kalispell Land Use Plan as recommended by the Kalispell City -County Planning Board as follows: Figure 111-1 , page III-9, chapter 3, is thereof amended to change the land use designation from "Suburban Residential" to "High Density Urban Residential" for that tract of land described as follows. A tract of land lying and being in the South 1/2 of the Southwest 1/4 Secti.on 33 Township 29 North Range 21 West and Gov Lot 3 of Section 4 Township 28 North Range 21 West, described as follows: Commencing at the Northeast corner of Gov Lot 3 of Section 4 Township 28 North Range 21 West, which point being the point of beginning, thence North 89046'00" West 277.50 feet to a point, thence South 001410011 West and along the westerly boundary of that certain tract of land, described in Book 80 Page 156 records of Flathead County, a distance of 242.7 374. feet to a point, thence North 89046'00" West 814 feet to the East boundary of that parcel described in Book 270 page 73 records of Flathead County, thence Southerly along the East boundary 41 feet more or less to the Southeast corner of said tract, thence westerly along the South boundary of said tract 258 feet to the Southwest corner of said tract. Thence North along the West boundary of said tract 338 feet to the Northwest corner of Gov Lot 3. Thence South 89146100" East to a point that is 1130 feet from the Southwest corner of Section 33 Township 29 North Range 21 West and the Southwest corner of that parcel described in Book 760 Page 176 records of Flathead County, thence North at right angles 249.3 feet to a point, thence East at right angles 190 feet to a point, thence North 0027100" West 175 feet more or less to the Northwest corner of that certain tract recorded in Book 375 Page 80 records of Flathead County, thence South 89146'00" East 870 feet more or less to the Northeast corner of that tract of land recorded in Book 659 Page 432 records of Flathead County, thence South 0022100" 115 feet to the Northwest corner of that tract of land recorded in Book 387 Page 358 records of Flathead County, thence Easterly and parallel to the Southerly boundary of Section 33 Township 29 North Range 21 West 435.6 feet more or less to the Westerly boundary of LaSalle Highway, thence Southwesterly and following the Westerly boundary of LaSalle Highway on a curve to the right a distance of 325 feet more or less to the point of beginning.
