A RESOLUTION TO ALTER AND AMEND THE PLANS AND SPECIFICATIONS OF CONTRACT
WITH MORGEN & OSWOOD CONSTRUCTION CO, INC., CONTRACTOR, ON KALISPELL SLUDGE
MANAGEME T FACILITIES - SCHEDULE B PROJECT.
WHIUM S, the City did, on September 9, 1983, enter into a contract with
Morgen. & Oswood Construction Co., Inc., P. 0. Box 3009, Great Falls, Montana,
59403 for Anaerolic Sludge Digestion Facility on the EPA Construction Grant
C300263-04; and
WHEREAS, upon the advice and recommendation of Stably Engineering &
Associates, who is the City's consultant and engineer on said project, certain
changes and alteration of design and specifications have been found necessary
and adviseable and in the best interests of the City;.and said changes and
alterations could not have been necessarily forseeable when the original design
and specifications were prepared on this phase of the Kalispell Sludge Manage-
ment Facilities - Schedule B, and said changes are contained in Exhibit "A"
and Exhibit "B" of Change Orders 1 and 2 and attached hereto and are by this
reference made a part hereof; and
WHEREAS, it appears in the best interests of the City to approve said
changes and alterations,
NOW THEREFORE, pursuant to the provisions of Section 7--5-4308(1) M.C.A.
be it hereby resolved:
1. The alterations and modifications of the specifications and plans
of the contract between the City of Kalispell and Morgen & Oswood. Construction
Co., Inc., dated September 9, 1983, as set out in Exhibit "A" attached hereto,
are hereby approved; and
2. his soon as the price to be paid for said alterations and modifications
are agreed to in writing, signed by the Contractor, as hereby approved by the
Council, this approval thereof shall be in effect.
PASSED BY THE CITY COUNCIL AND APPROVED BY THE MAYOR OF THE CITY OF KALISPELL
