A RESOLUTION TO APPROVE THE PRELIMINARY PLAT OF A SUBDIVISION OF
THE CITY OF KALISPELL, HAWTHORNE WEST (MASTER PLAN) SECTION 12,
T28N, R22W, KALISPELL, MONTANA, TO BE KNOWN AS THE "HAWTHORNE WEST
SUBDIVISION".
WHEREAS, James H. Burton, d/b/a Flathead Land Consultants has petitioned,
on behalf of Manuel V. Bauska and Dorothea F. Bauska, James B. McKnight and
Doreen L. McKnight, Garmen H. Meadows and F. Louise Meadows, the owners of
Hawthorne West", Kalispell, Montana, for the approval of a subdivision on said
premises to be known as "Hawthorne West", Kalispell, Montana, and all persons
having an interest in said premises have, in writing, consented to the subdivision
of said premises as required by Section 76-3-612, M. C . A . , and
WHEREAS, the Flathead Regional Development Office and the Kalispell
City -County Planning Board have reviewed and recommended the City approve
such subdivision, and
WHEREAS, the City Council, in considering this request as found, from the
Preliminary Plat and evidence relating thereto that said subdivision is in the
public interest, and in making such findings, the Council has considered and
weighed (a) the basis of the need for subdivision; (b) expressed public opinion;
(c) affects on agriculture; (d) affects on local services; (e) affects on taxation;
(f) affects on wildlife habitat; and (g) affects on public health and safety.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL, MONTANA
SECTION I. The application for approval for the preliminary plat of
the subdivision of "Hawthorne West", Kalispell, Montana is hereby ap-
proved and the same shall be hereinafter known as "Hawthorne West",
Kalispell, Montana, subject to the following conditions:
I. All requirements of the City of Kalispell and the Depart-
ment of Health and Environmental Sciences regarding water,
sewer, fire flow, drainage and other improvements be met
and be approved by the respective City Departments.
2. All common utility lines be placed in utility easements
and meet the requirements of Section 3.12 of the Kalispell
Subdivision Regulations.
3. Hawthorn Drive West be improved to City Standards and
be privately maintained. At the time of construction of
units IV through VII units, Hawthorn Drive West be con-
structed with a road base.
4. Access to parcel 2 be restricted to Hawthorn Drive West
and parcel 1 be allowed 1 access from Hawthorn Avenue in
addition to any access from Hawthorn Drive West.
5. A homeowner's association be formed and the covenants
and by-laws be filed with the County Clerk and Recorder.
Any amendments be approved by the City Council.
6. All common property including water and sewer systems
and landscaped areas be maintained by the Homeowner's
Association.
7. All required improvements be completed prior to approval
of the final plat or the developer shall enter into a written
subdivision improvements agreement with the City guaran-
teeing the construction and installation of all improvements.
8. All delinquent taxes be paid before approval of the final
plat.
9. Any future development plans for parcels 1 and. 2 meet
all bulk and dimensional requirements of the RA-1 zoning
district.
SECTION 1[. The classification of said premises under the Kalispell
Zoning Ordinance shall not be changed by this action.
SECTION III. That no portion of said premises need to be dedicated to
the City for park purposes.
SECTION IV. That upon proper review and filing of the final plat of
said subdivision in the office of the Flathead County Clerk and Recorder,
said premises shall be a subdivision of the City of Kalispell.
