Resolution 3544 - Budget - Special Lighting District 23 4-0 . RESOLUTLON 3 6'q A RESOLUTION LL+=G AND ASSESSING A TAX UPON ALL PROPERTY IN SPECIAL LIGHTING DISTRICT 90. II TO DEFRAY THE COSTS OF CONSTRUCTION AND ERECTION OF 21 METAL STANDARD STREET LIGHTS IN THE SUNSET ADDITION OF THE CITY OF KALISPELL. BE IT RESOLVED BY M MAYOR AND CITY COUNCIL OP TFI'w CITY OF KALISPELL, MONTANA, AS FOLLOWS: To defray the costs of construction and erection of 21 metal standard street lights authorized in that area of the City of Kalispell, as more part- icularly described in Resolution No. 3494 dated September 6, 1983 and on file in the office of the City Clerk -Treasurer, and is hereby levied and assessed against all said property a tax in the total sum of $28,500.00, plus interest as hereinafter provided. Said sum includes all costs of making said improvements and as allowed by Sections 7-12-41.69, 7-12-4122, M.C.A., and as certified to the City Clerk -Treasurer by the City Engineer upon completion and acceptance of said improvements. Said levy and assessment as is made hereunder against each lot or parcel of land within said district also shall include accruing interest thereon at the rate of 12% until paid from the date or registration of bonds sold and issued in accord with Resolution No. 3504 dated November 15, 1983, and if same is not paid in full when so levied and assessed, said sum shall, with interest at 12%, be spread over a term of not to exceed ten (10) years, payments to be made in equal annual installments a:, provided in Resolution No. 3504 dated November 15, 1983. Each lot or parcel of land within said district shall be assessed as follows: (1) The total cost of construction and erection of 21 metal standard lights, together with all the costs of engineering and administration on Special Lighting District No. II, the sum of $28,500.00 shall be assessed against each lot within the district for that part of the whole cost which its area bears to the area of the entire district. The description of each lot.or parcel within said district and the name of its owner and the amount chargeable thereto in accord with the foregoing method of making and determining the assessment and the amount of each partial payment thereof,tincluding interest, and the dates when same shall become delinquent is set forth on Exhibit ".A" attached hereto and which, by this ref- erence, does become a part hereof. The City Clerk -Treasurer is hereby directed to publish Notice hereof as provided by Sections 7-11-4176(3), 7-12-4178, M.C.A. This Council will meet and hear any objections to said levy and assessment and take final action thereon at the regular meeting of the City Council at the Council Chambers, City Hall, Kalispell, Montana, commencing at 7:30 P. ATTEST: Marjorie iermann, Clerk -Treasurer I, the undersigned, City Clerk of the City of Kalispell certify that the foregoing is a true copy of the Resolution passed V th City Council of the City of Kalispell, Montana at a regular meeting hold I- I City Cl�kk of the City of Kalispell 1 WMME S, the within and foregoing Resolution No. 3S `� , signed by the Mayor and City Clerk -Treasurer of the Council of the City of Kalispell, Montana, was filed in he o fice'of said Clerk -Treasurer of the Council on the day of . �,�� 1981�, and has since that date been on file in said office, subject to inspection, and the Clerk of the Council having given notice of the passing and filing of said Resolution by publication in the Daily Inter Lake, a newspaper printed and published in the City of Kalispell, Montana, at least five days before the date set herein for hearing objections thereto, and the City Council having been in session at the time and place for the hearing of objections, and no owner, or agent of any owner of lots, pieces or parcels of land situated within said Special Lighting District II or any other person, having appeared and protested against or objected to the final passage and adoption of said Resolution or to any assessment or tax hereby levied or assessed; and it appearing to the satisfaction of the City Council that the cost of the improvements within the said Special Lighting District II was necessary and proper, and that the cost thereof should be assess- ed accordingly as in said Resolution provided; NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KALISPELL, MONTANA: That the within and foregoing Resolution No. 3 4� 4 be and the same is hereby finally passed and adopted, and the said assessments therein provided for, and all thereof, be and the same are hereby levied and assessed accord- ingly, and that the first of said assessments are now due and payable to the City Treasurer of the City of Kalispell, Montana, and same will become delin- quent on �22 A_ -I 1 -3y , 19 �'.5 , at 5 : 30 P. M. of said day, and hereafter the annual payments as required shall become delinquent on the last day of (6-r�,si_�e c� of each year for which said annual amount is due at 5:00 P. M. of said day. The Clerk -Treasurer is also hereby ordered to deliver to the Kalispell City Treasurer a certified copy of this and the within and foregoing Resolution No. !,LgL within two (2) days after its passing.
