Ordinance 1859 - Second Reading - Ponderosa Veterinary Clinic Zoning This Ordinance would zone the Ponderosa Veterinary Clinic at 100 Ponderosa Lane, 13-1 Neighborhood Business. Public Comment Mayor Johnson opened public comment on the consent agenda. Seeing none, he closed public comment. Motion and Vote to approve the consent agenda. F. COMMITTEE REPORTS - None. G. PUBLIC HEARING — Preliminary Fiscal Year 2022 Budget Council will accept comments regarding the preliminary budget for fiscal year 2022. Mayor Johnson opened the public hearing and called for public comment. Seeing none, Mayor Johnson closed the public hearing. H. PUBLIC COMMENT Persons wishing to address the council on any issue not on the agenda were asked to do so. Mayor Johnson opened general public comment. Seeing none, he closed public comment. REPORTS, RECOMMENDATIONS, AND SUBSEQUENT COUNCIL ACTION Persons wishing to address the council on individual agenda items were asked to provide public comment via email to publiccomment cc,kalispell.com or during the meeting verbally in council chambers or via the online meeting. 1. Ordinance 1860 — First Readinu --- Downtown Historic District Design Standards This Ordinance would create Municipal Code Chapter 27.21 A and amend language in Chapter 27.21 and 27.22 to incorporate design standards for properties within the Downtown Historic Overlay and the Main Street Historic District. City Manager Doug Russell provided a brief overview of Council discussion on this issue. Planner Ezell provided additional information. 00:09:06 Councilor Waterman asked questions regarding public comment received regarding murals. Public Comment Mayor Johnson opened public comment. Julia Pierrottet Public Comment Julia Pierrottet with the Architectural Review Board with 20+ experience in historic architecture thanked Council for this opportunity to guide owners on how to maintain the historic character of buildings downtown and to guide any infill that happens. She then explained the guidelines related to murals. She further spoke in favor of this Ordinance explaining that this framework will help builders by providing them with guidelines to help them maintain the character and history of downtown. Seeing no further public comment, Mayor Johnson closed public comment. 00:13:25 Motion to approve the first reading of Ordinance 1860, an ordinance amending ordinance 1677 of the City of Kalispell Zoning regulations codified at Chapter 27 of the Kalispell Municipal Code relating to portions of Architectural Review regulations, and adding Downtown Historic District Design Standards, declaring an effective date, and authorizing the City Attorney to codify. Council Member — Kyle Waterman: motion Council Member — Sam Nunnally: 2nd Councilor Waterman provided discussion on the motion. 00:14:56 Councilor Daoud said he would support this motion but has concerns regarding the possible economic burden of this Ordinance. Agreement to Rescind Memorandum of Understanding with the State of Montana Department of Natural Resources and Conservation regarding Funding of Roundabout at Stillwater Road and Farmstead Parkway This agreement would rescind the September 29, 2008, MOU with DNRC and establish the financing of the intersection at a later date. City Manager Doug Russell provided information on this item. City Attorney Charles Harball provided additional background on this item. Public Comment Mayor Johnson opened public comment. Seeing none, he closed public comment. 00:21:55 Motion and Vote to approve the recission of the September 29, 2008, Memorandum of Understanding with the State of Montana DNRC regarding the funding for the construction of a roundabout on Stillwater Road at Farmstead Parkway. CITY MANAGER, COUNCIL, AND MAYOR REPORTS (No Action) City Manager Doug Russell provided the following report: Page 4 of 5 Kalispell City Council Minutes, July 6, 2021 • July 12, 2021, Work Session: Continuing discussion of the Montana Marijuana Regulation and Taxation Act — Mr. Russell described a possible framework for the Council to consider with this discussion. • Manager Russell introduced new Fire Chief Dan Pearce who started today. 00:24:48 Councilor Daoud said he is happy that Kalispell is no longer under an emergency ordinance. 00:25:16 Councilor Nunnally thanked the Fire and Police Departments for their responses over the past busy 41h of July weekend. 00:25:40 Mayor Johnson spoke regarding public comment that was received over the weekend with noise complaints from an event (Rave) at the Fairgrounds. He explained that the city does not control what happens at the Fairgrounds, however they did pass on the complaints to the appropriate people at the county. 00:26:06 Mayor Johnson spoke about the 41h of July Parade saying it was well attended. He thanked Kalispell Kruise for sponsoring the parade. K.
